.....appearing; It is hereby enacted as follows : Section 1 Short title This Act may be called the Bihar and Orissa Municipal (West Bengal Amendment) Act, 1962. Section 2 Application of the Act The Bihar and Orissa Municipal Act, 1922 (hereinafter referred to as the said Act), shall in its application to West Bengal, be amended for the purpose and in the manner hereinafter provided. Section 3 Substitution of new section for section 130 of Bihar and Orissa Act 7 of 1922 For section 130 of the said Act, the following section shall be substituted, namely : "130. Power of Commissioners to bring suits in the event of failure to realise any tax as a public demand. (1) In the event of failure to realise as a public demand the whole or any part of any tax the Commissioners may sue the person liable to pay the same in any court of competent jurisdiction. (2) Notwithstanding any decision of any court to the contrary, any proceeding instituted in accordance with the provisions of sections 124 to 129B and pending on the date of commencement of the Bihar and Orissa Municipal (West Bengal Amendment) Act, 1962, may be continued after such commencement and any such proceeding, or any order.....

Section 9 Act not to affect certain voluntary contributions Nothing in this Act shall affect contributions voluntarily made over or remitted to any person in authority, or any Bank authorised by the Central Government or the State Government to receive such contributions. Section 10 Power to make rules The State Government may make rules to carry out purposes of this Act. Section 11 Repeal and savings (1) The National Defence Fund (West Bengal Collection) Ordinance, 1962, is hereby repealed. (2) Anything done or any action taken under the National Defence Fund (West Bengal Collection) Ordinance, 1962, shall be deemed to have been validly done or taken under this Act as if this Act had commenced on the 11th day of November, 1962. Act 6 of 1908 For clause (a) of sub-section (1) of section 46A of the said Act, the following clause shall be, and shall be deemed always to have been, substituted, namely : "(a) a transfer to the Government, or to a person belonging to the community, tribe or caste, to which the transferor belongs.". Section 4 Repeal and savings (1) The Chota Nagpur Tenancy (West Bengal Amendment) Ordinance, 1962, is hereby repealed. (2) Anything done or any action taken under the said Act as amended by the Chota Nagpur Tenancy (West Bengal Amendment) Ordinance, 1962, shall be deemed to have been validly done or taken under the said Act as amended by this Act as if this Act had commenced on the 7th day of September, 1962. Section 2 Amendment of section 4 of Cooch Behar Act 3 of 1944 In clause (2) of section 4 of the Cooch Behar Municipal Act, 1944 (hereinafter referred to as the said Act), for the words "ten feet", the words "three metres" shall be substituted. Section 3 Amendment of section 13 In section 13 of the said Act, (i) for sub-section (.1), the following sub-section shall be substituted, namely: "(1) The Magistrate in charge of the subdivision in which a Municipality is situated or any other Magistrate of the first or second class authorised by him in writing in this behalf shall prepare and publish at the time and in the manner prescribed an electoral roll showing the names of persons qualified to vote at an election of Commissioners."; (ii) in sub-section (5), for the words "Commissioners at a meeting" the words "Magistrate by whom the electoral rolls were prepared and published under sub-section (1)" shall be substituted; and (iii) after sub-section (5), the following sub-section shall be inserted, namely: "(6) The cost.....
