West Bengal Legislature (Removal of Disqualifications) Act, 1952 Complete Act

.....for being chosen as, and for being, a member of the West Bengal Legislative Assembly or the West Bengal Legislative Council by reason only of the fact that he holds any of the following offices of profit under the Government of India or the Government of any State specified in the First Schedule to the Constitution of India, namely: (a) an office of a Parliamentary Secretary or a Parliamentary Under-Secretary: (b) an office which is not a wholetime office remunerated either by salary or by fees.". It is hereby declared that a person shall not be disqualified for being chosen as, and for being, a member of the West Bengal Legislative Assembly or the West Bengal Legislative Council by reason only of the fact (i) that he holds any of the following offices of profit under the Government of India or the Government of any State specified in the First Schedule to the Constitution of India, namely: (a) an office of a Parliamentary Secretary or a Parliamentary Under-Secretary; (b) an office which is not a wholetime office remunerated either by salary or by fees; 22. .....a member of both the West Bengal Legislative Assembly and the West Bengal Legislative Council of his seat in one House or the other ; It is hereby enacted as follows : Section 1 Short title and commencement (1) This Act may be called the West Bengal Legislature (Prohibition of Simultaneous Membership) Act, 1952. (2) It shall come into force immediately on the West Bengal Legislature (Prohibition of Simultaneous Membership) Ordinance, 1952, ceasing to operate. Section 2 Prohibition of simultaneous membership (1) Any person who is chosen a member of both the Houses of the West Bengal Legislature, and who has not taken a seat in any of the Houses, may, by notice in writing signed by him and delivered to the Secretaries of both the Houses, or to any person authorised by the Governor in this behalf, within ten days from the date of publication in the Official Gazette of the declarations that he has been so chosen or, if such publications have been made on different dates, within ten days from the, later of such dates, as the case may be, intimate in which of the Houses he wishes to serve, and any choice so intimated shall be conclusive and his seat in the House in which he does.....

.....thereof, any apparatus for amplifying or reproducing the human voice, such as a megaphone or a loud-speaker, or (b) shout, or otherwise act in a disorderly manner, within or at the entrance of the polling station or in any public or private place within a distance of the hundred yards of the polling station, so as to cause annoyance to any person visiting the polling station for the poll, or so as to interfere with the work of the officers and other persons on duty at the polling station. (2) Any person who contravenes, or wilfully aids or abets the contravention of, the provisions of sub-section (1) shall be punishable with imprisonment which may extend to three months or with tine or with both. (3) If the presiding officer of a polling station has reason to believe that any person is committing or has committed an offence punishable under this section, he may direct any police officer to arrest such person, and thereupon the police officer shall arrest him. (4) Any police officer may take such steps, and use such force, as may be reasonably necessary for preventing any contravention of the provisions of sub-section (1), and may seize any apparatus used for such.....
