The Tamil Nadu Home Guard Act (Iii of 1963) Complete Act

.....within the meaning of section 21 of the Indian Penal Code (Central Act XLV of 1860) (Sub-section (1) of S.17 and the brackets and figure "(2)" occurring at the commencement of sub-section (2) omitted by Tamil Nadu Act III of 1967) 17. Removal of disqualifications. " Notwithstanding anything to the contrary contained in any other law for the time being in force, a member of the Home Guard shall not be disqualified for being chosen as, or for being, a member of any local authority by reason only to the fact that he is a member of the Home Guard. 18. Repeals " The (Substituted by Tamil Nadu Adaptation Oder of 1969) [Tamil Nadu] Home Guards Act, 1948 (Tamil Nadu Act I of 1948) and the [Tamil Nadu] Home Guard Ordinance, 1963 (Tamil Nadu Ordinance II of 1963), are hereby repealed. .....or with the consent of the municipal council, in respect of any particular municipality or portion thereof, exempt all buildings or any class of buildings from all or any of provisions of Chapter X of the said Act or the rules made thereunder. In the new chapter X-A incorporated by Tamil Nadu Act 58 of 1992, which is applicable to hills stations, there are no provisions enabling the Government to exempt any building or class of buildings from the provisions of the said Chapter X-wsA. The Government have therefore decided that provisions should be made in Chapter X-A of the Tamil Nadu District Municipalities Act, 1920 enabling the State Government if they are satisfied that it will not result in the deterioration of scenic beauty or destruction of the environment and eco-system of the hill stations to exempt from the provisions of Chapter X or chapter X-A of the said Act or relax the rules made under Chapter X or Chapter X-A of the said Act in respect of any building or class of buildings apart form the Central or State Government. 2. .....Madras Hindu Religious and Charitable Endowments Act, 1951 (Madras Act XIX of 1951), in its application to the Malabar district referred to in sub-section (2) of section 5 of the States Reorganisation Act, 1956, for the purposes hereinafter appearing; BE it enacted in the Fourteenth Year of the Republic of India as follows:- 1. Short title and commencement.- (1) This Act may be called the Madras Hindu Religious and Charitable Endowments (Amendment) Act, 1963. (2) It shall come into force at once. 2. Amendment of section 30.- In section 30 of the Madras Hindu Religious and Charitable endowments Act, 1951 (Madras Act XIX of 1951),- (i) for sub-section (1), the following sub-section shall be substituted, namely:- " (1) the trustee of a religious institution may, after making adequate provision for the purposes referred to in sub-section (2) of section 70,- (i) incur expenditure out of the funds in his charge- (a) on arrangements for securing the health, safety or convenience of disciples, pilgrims or worshippers resorting to the institution; and (b) for the training of archakas, adhyapakas, vedaparayanikas and othuvars; and (ii) make contributions in cash or in gold.....
