.....agriculture and allied sectors; or (F) such other sectors as may be notified by the Central Government in this behalf; or (ii) production or manufacture of any article or substance for which patent has been granted to the National Research Laboratory or any other scientific research institution approved by the Department of Science and Technology;'; (k) in clause (23G), with effect from the 1st day of April, 2000, - (A) for the words "the business of developing, maintaining and operating", the words, brackets and figures "the business of (i) developing, (ii) maintaining and operating, or (iii) developing, maintaining and operating" shall be substituted; (B) in the Explanation, in clause (c), - (i) in sub-clause (i), for the word, brackets, figure and letter "sub-section (4A)", the words, brackets and figures "sub-clause (i) of sub-section (4)" shall be substituted; (ii) for sub-clause (ii), the following sub-clause shall be substituted, namely :- "(ii) an industrial undertaking which - (a) is set up in any part of India for the generation or generation and distribution of power if it begins to generate power at any time during the period beginning on the 1st day.....

Title: The Register of Trade Marks

.....be lawful for the Registrar to keep the records wholly or partly in computer floppies, diskettes or in any other electronic form subject to such safeguards as may be prescribed. (3) Where such register is maintained wholly or partly on computer under subsection (2) any reference in this Act to entry in the register shall be construed as the reference to any entry as maintained on computer or in any other electronic form. (4) No notice of any trust, express or implied or constructive, shall be entered in the register and no such notice shall be receivable by the Registrar. (5) The register shall be kept under the control and management of the Registrar. (6) There shall be kept at each branch office of the Trade Marks Registry a copy of the register and such of the other documents mentioned in section 148 as the Central Government may, by notification in the Official Gazette, direct. (7) The Register of Trade Marks, both Part A and Part B, existing at the commencement of this Act, shall be incorporated in and form part of the register under this Act.

Title: Capital Account Transactions

(2) The Reserve Bank may, in consultation with the Central Government, specify - (a) any class or classes of capital account transactions which are permissible; (b) the limit up to which foreign exchange shall be admissible for such transactions: Provided that the Reserve Bank shall not impose any restriction on the drawal of foreign exchange for payments due on account of amortization of loans or for depreciation of direct investments in the ordinary course of business. (3) Without prejudice to the generality of the provisions of sub-section (2), the Reserve Bank may, by regulations prohibit, restrict or regulate the following: - (a) transfer or issue of any foreign security by a person resident in India; (b) transfer or issue of any security by a person resident outside India; (c) transfer or issue of any security or foreign security by any branch, office or agency in India of a person resident outside India; (d) any borrowing or lending in foreign exchange in whatever form or by whatever name called; (e) any borrowing or lending in rupees in whatever form or by whatever name called between a person resident in India and a person resident.....

Title: Removal from Office

(1) The Central Government may remove from office any member who-- (a) is, or at any time has been, adjudged as an insolvent; or (b) has become physically or mentally incapable of acting as a member; or (c) has been convicted of any offence which, in the opinion of the Central Government, involves moral turpitude; or (d) has acquired such financial or other interest as is likely to affect prejudicially his functions as a member; or (e) has so abused his position as to render his continuation in office detrimental to the public interest. (2) No such member shall be removed under clause (d) or clause (e) of subsection (1) unless he has been given a reasonable opportunity of being heard in the matter.

(2) If at any time, the appropriate authority, on the advise of technical officer is satisfied that the availability of ground water has improved in an over exploited water shed it may by notification cancel the declaration made under sub-section (1).

Title: Generating Companies and Generating Stations

.....to obtain approvals and sanctions of the State Government or any other authority under any other law, rule or regulations. (2) The provisions of section 44 of the Electricity (Supply) Act, 1948 shall apply in regard to applications for consent to the establishment or acquisition of a new generating station, or to extend or replace any major unit or plant or works pertaining to generation of electricity in a generating station, to meet the applicants need for the electricity, subject to the following modifications:- (a) the applicant shall apply for and obtain the prior consent in writing of the Commission in place of the Board; (b) the Commission shall record the reasons for the grant or refusal of the consent. (3) No generating company or generating station, except to the extent of the business of sale of electricity to the bulk purchaser or licensee or to such other person specifically authorised by the Commission, shall engage in the business of sale or supply of electricity or transmission of electricity in the State. (4) No generating company or generating station shall, at any time, without the previous consent in writing of the Commission, acquire by purchase.....

Title: Term of Office, Conditions of Service Etc. of Members

(1) Every member shall hold office for a period of five years from the date of his appointment as member or until the age of sixty-five years whichever is earlier and he shall not be eligible for reappointment in the Commission at any time after the expiry of his term of appointment: Provided that a member shall be eligible for appointment as Chairman subject to his combined tenure in the Commission as Member and Chairman shall not exceed five years : Provided further that the first three members shall be appointed for varying periods of three years, four years and five years respectively so as to avoid the retirement of all the first appointed members at the same time: Provided also that no person shall be appointed as member after he has completed the age of sixty-two years. (2) The Chairman and other members shall receive such remuneration and other allowances and shall be governed by such conditions of service as may be prescribed : Provided that the conditions of service once prescribed shall not be varied to the disadvantage of the members during the tenure of their appointment. .....the geographical indication as altered shall be advertised in the prescribed manner, unless the application has already been advertised under sub-section (2). Section 30 - Adaptation of entries in register to amend or substitute classification of goods (1) The Registrar shall not make any amendment of the register which would have the effect of adding any goods or classes of goods to those in respect of which a geographical indication is registered (whether in one or more classes) immediately before the amendment is to be made or antedating the registration or a geographical indication in respect of any goods: Provided that this sub-section, shall not apply when the Registrar is satisfied that compliance therewith would involve complexity and that the addition or antedating, as the case may be, would not affect any substantial quantity of goods and would not substantially prejudice the rights of any person. (2) A proposal so to amend the register shall be brought to the notice of the registered proprietor and every authorised user of the geographical indication affected and advertised in the prescribed manner, and may be opposed before the Registrar by any person.....
