Karnataka Regularisation of Unauthorised Constructions in Urban Areas Act, 1991 Section 6

Title: Competent Authority

State: Karnataka

Year: 1991

.....Scale officer to be a Competent Authority for such area or areas as may be specified by it, and two or more Competent Authorities may be appointed in respect of the same areas. (2) The Competent Authority shall, scrutinise the application received under section 3, and after holding an enquiry in accordance with such rules as may be prescribed and subject to payment being made according to the provisions hereinafter contained, make a provisional order of regularisation of unauthorised constructions, and where such construction is situated on the land belonging to the State Government, may, for the purpose of regularising the construction also make a provisional order for grant of the appurtenant land included in the said construction, subject to such maximum extent that a may be prescribed. (3) Burden of proving that an unauthorised construction was made prior to the first day of January, 1995 shall lie on the applicant who seeks regularisation of such unauthorised construction.] ________________________________ 1. Hyderabad-karnataka Area Development Board Act, 1991 Section 6

Title: Removal of Member

The State Government shall remove the Chairman or other member if,- (a) he becomes subject to any of the disqualifications mentioned in section 5: Provided that no Chairman or member, shall be removed on the ground that he has become subject to the disqualification mentioned in clause (e) of sub-section (1) of that section, unless he has been given an opportunity of making his representation against the proposal; or (b) he refuses to act or become incapable of acting; or (c) he without obtaining leave of absence from the Board, absents from three consecutive meetings of the Board; or (d) in the opinion of the State Government he has so abused his position as to render his continuance in office detrimental to the public interest: Provided that no member shall be removed under this clause unless he has been given an opportunity of making his representation against the proposal.

Karnataka Land (Restriction on Transfer) Act, 1991 Section 6

Title: Appeals Against Orders of Competent Authority

(1) Any person aggrieved by an order of the competent authority under section 5 may, within thirty days of the date of receipt of the order by him, file an appeal to the prescribed authority in such form and containing such particulars as may be prescribed. (2) On receipt of an appeal under sub-section (1), the prescribed authority shall, after giving the appellant an opportunity of being heard in the matter dispose of the appeal as expeditiously as possible. (3) Every order made by the prescribed authority in appeal under this section shall be final.

Kannada University Act, 1991 Section 6

Title: Admission to the University

(1) The University shall subject to the provisions of this Act and the statutes, be open to all persons. (2) Nothing contained in sub-section (1) shall require the University,- (a) to admit to any course of study any person who does not possess the prescribed academic qualification or standard; (b) to retain on the rolls of the University any student whose academic record is below the minimum standard required for the award of a degree, diploma or other academic distinction; or (c) to admit any person or retain any student whose conduct is prejudicial to the interests of the University or the rights and privileges of other students and teachers.

Places of Worship (Special Provisions) Act, 1991 Section 6

Title: Punishment for Contravention of Section 3

State: Central

Year: 1991

(1) Whoever contravenes the provisions of section 3 shall be punishable with imprisonment for a term which may extend to three years and shall also be liable to fine. (2) Whoever attempts to commit any offence punishable under sub-section (1) or to cause such offence to be committed and in such attempt does any act towards the commission of the offence shall be punishable with the punishment provided for the offence. (3) Whoever abets, or is a party to a criminal conspiracy to commit, an offence punishable under sub-section (1) shall, whether such offence be or be not committed in consequence of such abetment or in pursuance of such criminal conspiracy, and notwithstanding anything contained in section 116 of the Indian Penal Code, be punishable with the punishment provided for the offence.

Public Liability Insurance Act, 1991 Section 6

Title: Application for Claim for Relief

State: Central

Year: 1991

(1) An application for claim for relief may be made-- (a) by the person who has sustained the injury; (b) by the owner of the property to which the damage has been caused; (c) where death has resulted from the accident, by all or any of the legal representatives of the deceased; or (d) by any agent duly authorised by such person or owner of such property or all or any of the legal Representatives of the deceased, as the case may be: Provided that where all the legal representatives of the deceased have not joined in any such application for relief, the application shall be made on behalf of or for the benefit of all the legal representatives of the deceased and the legal representatives who have not so joined shall be impleaded as respondents to the application. (2) Every application under sub-section (1) shall be made to the Collector and shall be in such form, contain such particulars and shall be accompanied by such documents as may be prescribed. (3) No application for relief shall be entertained unless it is made within five years of the occurrence of the accident.

Remittances of Foreign Exchange and Investment in Foreign Exchange Bonds (Immunities and Exemptions) Act, 1991 Section 6

.....and source of the investment in such Bonds; (b) no inquiry or investigation shall be commenced against any of the persons referred to in clause (a) under any of the said Acts on the ground that such person owns such Bonds; (c) the fact that any of the persons referred to in clause (a) owns such Bonds shall not be taken into account and shall be inadmissible as evidence in any proceedings relating to any offence or the imposition of any penalty under any of the said Acts. (2) Nothing in sub-section (1) shall apply to foreign exchange which is required to be brought into India under any of the provisions of-- (i) the Foreign Exchange Regulation Act, 1973 (46 of 1973); or (ii) the Income-tax Act, 1961 (43 of 1961), read with the Foreign Exchange Regulation Act, 1973 (46 of 1973), if the period within which such foreign exchange is to be brought into India has not expired or where such period has been extended, in any manner, by the Central Government or the Reserve Bank of India or any other authority, such extended period has not expired on the date of commencement of this Act.
