Title: Payment of Compensation

.....be set off, in the first instance, against the first instalment of the cash payment referred to in sub-section (2), and in case the payment so obtained exceeds the amount of the first instalment, the excess amount shall be adjusted against the second instalment and the balance of such excess amount, if any, against the third instalment of the cash payment. (9) Any payment purported to have been made to an existing bank under sub-section (3) of section 15 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1969 (22 of 1969), shall be deducted by the Central Government from the amount of the interim payment made to such existing bank under sub-section (7) or where no such interim payment has been made, from the total amount of the compensation due to such existing bank, and the amount so deducted shall be paid by the Central Government to the corresponding new bank.

Title: Notice to Be Given in Case of Under Presented Indian Soldier

[S.6 was re-numbered as sub-section (1) of that section by Ordinance 64 of 1942,Section3.][(1)] If a Collector has certified under section 5, or if the Court has reason to believe. that an Indian soldier, who is a party to any proceeding pending before it, is unable to appear therein, and if the soldier is not represented by any person duly authorised to appear, plead or act on his behalf, the Court shall suspend the proceeding, and shall give notice thereof in the prescribed manner to the prescribed authority: Provided that the Court may refrain from suspending the proceeding and issuing the notice if (a) the proceeding is a suit, appeal or application instituted or made by the soldier, alone or conjointly with others with the object of enforcing a right of pre-emption, or (b) the interests of the soldier in the proceeding are, in the opinion of the Court, either identical with those of any other party to the proceeding and adequately represented by such other party or merely of a formal nature. Title: Power to Remove Difficulties

.....by order notified in the Official Gazette, make such provisions or give such directions, not inconsistent with the provisions of such Act, as appear to it necessary for the removal of the difficulty : Provided that no such order shall be made under this section after the expiration of two years from the date on which this Act comes into force. (2) In particular, and without prejudice to the generality of the foregoing power, any such notified order may -- (a) specify the corresponding authorities within the meaning of section 4, (b) provide for the transfer of any matter pending immediately before the commencement of this Act before any Court, tribunal or other authority, to any corresponding Court, tribunal or other authority for disposal, (c) specify the areas or circumstances in which, or the extent to which, or the conditions subject to which, any thing done or any action taken (including any of the matters specified in the second proviso to Sec. 5) under any law repealed by that section shall be recognised or given effect to under the corresponding provision of the Act now extended.

Section 26 - Cognizance of offences No court shall take cognizance of any offence under this Act except on a complaint made by, or with the previous sanction in writing of, the inspector and no court inferior to that of a Presidency Magistrate or a Magistrate of the first class shall try any offence punishable under this Act. Section 27 - Limitation of prosecutions No court shall take cognizance of an offence punishable under this Act unless the complaint thereof is made within three months from the date on which the alleged commission of the offence came to the knowledge of an inspector: Provided that where the offence consists of disobeying a written order made by an inspector, complaint, thereof may be made within six months of the date on which the offence is alleged to have been committed.

Title: Substitution of New Section for Section 13

For section 13 of the Income-tax Act, the following section shall be substituted with effect from the 1st day of April, 1971, namely :- 13.
