GOA, DAMAN AND DIU JUDICIAL COMMISSIONER'S COURT (DECLARATION AS HIGH COURT) ACT, 1964[REPEALED] Section 6

Title: Exceptions and modifications subject to which the provisions of Chapter V of Part VI of the Constitution apply to the Judicial Commissioner's Court

The provisions of Chapter V of Part VI of the Constitution shall in their application to the Judicial Commissioner's Court have effect subject to the following exceptions and modifications, namely: - (a) The provisions of Articles 216, 217, 218, 220, 221, 222, 223, 224, 224A, 225, 230 and 231 shall not apply; (b) References - (i) In Article 219, in the proviso to clause (3) of Article 227 and in Article 229 to the Governor shall be construed as references to the administrator of the Union territory of Goa, Daman and Diu; (ii) In Articles 219 and 229 to the State (except in the expression "the State Public Service Commission") shall be construed as references to the Union territory of Goa, Daman and Diu; (c) The reference to the State Public Service Commission in the proviso to clause (1) of Article 229 shall be construed as a reference to the Union Public Service Commission.

Bangalore Water Supply and Sewerage Act, 1964 Section 6

Title: Removal or Suspension of Members

.....a member of Parliament or any State Legislature or any local authority; or (e) in the opinion of the State Government,- (i) has refused to act; or (ii) has become incapable of acting; or (iii) has so abused his position as a member as to render his continuance on the Board detrimental to the interests of the general public; or (iv) is otherwise unfit to continue as a member; or (f) is convicted of an offence involving moral turpitude. (2) The State Government may suspend any member pending an inquiry against him. (3) No order or removal shall be made under this section unless the member concerned has been given an opportunity to submit his explanation to the State Government and when such order is passed, the seat of the member removed shall become vacant and another member may be appointed under section 3 to fill up the vacancy. (4) A member who has been removed shall not be eligible for re-appointment as member or in any other capacity to the Board.
