Special Marriage Act, 1954 Chapter VI

Title: Nullity of Marriage and Divorce

.....other than the petitioner; or (iii) the consent of either party to the marriage was obtained by coercion or fraud, as defined in the Indian Contract Act, 1872 (9 of 1872): Provided that, in the case specified in clause (ii), the court shall not grant a decree unless it is satisfied,-- (a) that the petitioner was at the time of the marriage ignorant of the facts alleged; (b) that proceedings were instituted within a year from the date of the marriage; and (c) that marital intercourse with the consent of the petitioner has not taken place since the discovery by the petitioner of the existence of the grounds for a decree: Provided further that in the case specified in clause (iii), the court shall not grant a decree if,-- (a) proceedings have not been instituted within one year after the coercion had ceased or, as the case may be, the fraud had been discovered; or (b) the petitioner has with his or her free consent lived with the other party to the marriage as husband and wife after the coercion had ceased or, as the case may be, the fraud had been discovered. Taxation Laws (Extension to Jammu and Kashmir) Act, 1954 Section 6

.....to have effect for the purposes of the levy assessment and collection of income-tax and super-tax or for the purposes of any penalty, interest, composition-fee or any other demand under that Act in respect of any period prior to the previous year for the purposes of assessment under the Indian Income-tax Act, 1922, for the year ending on the 31st day of March, 1955. (2) Without prejudice to the provisions contained in sub-section (1) and subject thereto, section 6 of the General Clauses Act, 1897 shall apply in relation to the repeal of any of the laws referred to in section 5 as if the law so repealed had been an enactment within the meaning of section 6 of that Act.

Title: Prohibition of Import Into, and Export From, India of Certain Advertisements

No person shall import into, or export from, the territories to which this Act extends any document containing an advertisement of the nature referred to in Sec. 3 or in Sec. 4 or Sec. 5, and any document containing any such advertisements shall be deemed to be goods of which the import or export has been prohibited under Sec. 19 of the Sea Customs Act, 1878 (8 of 1878),1and all the provisions of that Act shall have effect accordingly, except that Sec. 1832thereof shall have effect as if for the word "shall" therein the word "may" were substituted. ________________________ 1. Displaced Persons (Claims) Supplementary Act, 1954 [Repealed] Section 6

Title: Powers of Settlement Officers

(1) The Chief Settlement Commissioner, the Joint or Deputy Chief Settlement Commissioner or a Settlement Commissioner, an Additional Settlement Commissioner or a Settlement Officer shall have the same powers as are vested in a Civil Court under the Code of Civil Procedure, 1908, when trying a suit, in respect of the following matters, namely:- (a) summoning and enforcing the attendance of any person and examining him on oath; (b) requiring the discovery and production of any document: (c) requisitioning any public record from any Court or office: (d) issuing commissions for the examination of witnesses; (e) appointing guardians or next friends of persons who are minors or of unsound mind; (f) any other matter which may be prescribed. (2) A Settlement Officer may, if he so thinks fit, and shall, if so required by the Chief Settlement Commissioner, appoint one or more persons as assessors to advise him in any proceeding before him.

Transfer of Evacuee Deposits Act, 1954 [Repealed] Section 6

Title: Transfer of Records Relating to Transferable Deposit

(1) Where a transferable deposit is directed to be transferred to Pakistan under the provisions of section 5, the Custodian may send the record relating to the deposit or, if it is expedient so to do, only a certified copy of such part of the record as, in the opinion of the Custodian, is material to the case to the Government of Pakistan or to such officer or authority to whom or to which the deposit has been directed to be transferred. (2) If a certified copy only is sent pursuance of sub-section(1), the original record, together with a copy of the order of the Custodian under section 5, shall be returned to the court or other authority from which it was obtained.

High Court Judges (Salaries and Conditions of Service) Act, 1954 Section 6

Subject to the maximum limit specified in sub-section (1) of section 5, leave on half allowances may be granted to a Judge in excess of the amount at his credit-- (i) on medical certificate; or (ii) otherwise than on medical certificate, for not more than six months1[or for two or more periods, not exceeding in the aggregate, six months] during the whole period of his service as a Judge : Provided that no such leave shall be granted if the Judge is not expected to return to duty at the end of such leave and earn the leave granted. _________________________ 1. Displaced Persons Compensation and Rehabilitation Act 1954 [Repealed] Section 6

Title: Relief to Certain Banking Companies

.....to the displaced person is payable in the form of transfer of any property from the compensation pool, then subject to a prior charge under sub-section (3) of section 20, to a second charge on such property for the amount which would have been payable to the banking company under clause (a) if the displaced person had been paid compensation in cash; (c) if the compensation to the displaced person is payable in any other form, to such relief as the Settlement Officer, having regard to the principle specified in clause (a) or clause (b), may determine. (3) For the purposes of this section,-- (a) the expression 'banking company' means any of the displaced banks specified in the Schedule and includes any other banking company which, before the fifteenth day of August, 1947 carried on the business of banking, whether wholly or partially in any area now forming part of West Pakistan, and which the Central Government may, having regard to the dislocation of such business on account of the partition of the country, by notification in the Official Gazette, specify in this behalf; (b) the expression 'total debt' means,-- (i) where the banking company has preferred a claim.....

(1) No court shall take cognizance of any offence punishable under this Act save on complaint made by an officer empowered in this behalf by the Central Government by a General or special order. (2) No court inferior to that of a presidency magistrate or a magistrate of the first class shall try any offence punishable under this Act.
