Anti Hijacking Act 1982 Amending Act 1

.....code of criminal Procedure, 1973 (2 of 1974).-- (a) all offences under this act shall be tribally only by the Designated Court specified under Sub-section (1) of section 6A. (b) where a person accused of or suspected of the commission of an offence due this act is forwarded to a Magistrate under sub-section (2) or sub-section (2A) of section 167 of the Code of criminal Procedure, 1973 (2 of 1974), such Magistrate may authorise the detention of such person in such custody as he thinks fit for a period not exceeding fifteen days in the whole where such Magistrate is a Judicial Magistrate and seven days in the whole where such Magistrate is an executive Magistrate: Provided that where such Magistrate considers,- (i) when such person is forwarded to him as aforesaid; or (ii) upon or at any time before the expiry of the period of detention authorised by him. That the detention of such person is unnecessary, he shall order such person to be forwarded to the Designated court having jurisdiction; (c) the Designated Court may exercise, in relation to the person forwarded to it under clause (b), the same power which a Magistrate having jurisdiction to try a case may exercise.....

.....of this sub-section, the expression hundred per cent export-oriented undertaking shall have the meaning assigned to it in Explanation 2 to sub-section (1) of section 3 of the Central Excise Act, 1944 (1 of 1944)] (3) If the Central Government, in respect of the dumped article under inquiry, is of the opinion that - (i) there is a history of dumping which caused injury or that the importer was, or should have been, aware that the exporter practices dumping and that such dumping would cause injury; and (ii) the injury is caused by massive dumping of an article imported in a relatively short time which in the light of the timing and the volume of imported article dumped and other circumstances is likely to seriously under-mine the remedial effect of the anti-dumping duty liable to be levied, the Central Government may, by notification in the Official Gazette, levy anti-dumping duty retrospectively from a date prior to the date of imposition of anti-dumping duty under sub-section (2) but not beyond ninety days from the date of notification under that sub-section, and notwithstanding anything contained in any law for the time being in force, such duty shall be payable at.....

Anti Hijacking Act, 1982 Complete Act

.....and which extend to, and are binding on, India on the date of commencement of this Act. (2) For the purposes of the application of the Extradition Act, 1962-to offences under this Act, any aircraft registered in a Convention country shall, at any time while that aircraft is in flight, be deemed to be within the jurisdiction of that country, whether or not it is for the time being also within the jurisdiction of any other country. SECTION 07A: PROVISION AS TO BAIL 6- (1) Notwithstanding anything in the Code of Criminal Procedure, 1973 (2 of 1974)-, no person accused of an offence punishable under this Act shall, if in custody, be released on bail or on his own bond unless- (a) the Public Prosecutor has been given an opportunity to oppose the application for such release', and (b) where the Public Prosecutor opposes the application, the Court is satisfied that there are reasonable grounds for believing that he is not guilty of such offence and that he is not likely to commit any offence while on bail. (2) The limitations on granting of bail specified in sub-section (1) are in addition to the limitations under the Code of Criminal Procedure, 1973 (2 of 1974)-or any other.....

Short title and commencement.- (1) This act may be called the Anti-Hijacking (Amendment) Act, 1994. (2) I shall come into force on such date as the Central government may, by notification in the Official Gazette, appoint. 2. Insertion of new section 5A.- After section 5 of the Anti-Hijacking Act, 1982.(65 of 1982).(hereinafter referred to as the principal act,) the following section shall be inserted, namely:- "(5A). Conferment of powers of investigation etc.--(1) Notwithstanding anything contained in the Code of Criminal Procedure, 1973, for the purposes of this act, the Central Government may, by notification in the Official Gazette, confer on any officer of the Central government, powers of arrest, investigation and prosecution exercisable by a police officer under the code of criminal Procedure, 1973 (2 of 1974). .....

SIKKIM ANTI DRUGS ACT, 2006 SIKKIM ANTI DRUGS ACT, 2006 (Act No. 2 of 2006) AN ACT to control, regulate and prevent the abuse of drugs and controlled substances with abuse potential being misused by addicts and traffickers, to make stringent provisions to deal with the ever increasing phenomenon of abuse of medicinal preparations and for matters connected therewith. Beit enacted by the State Legislature in the Fifty-seventh Year of Republic of India as follows:- CHAPTER I PRELIMINARY Short Title, extent and commencement 1. (1) This Act may be called the Sikkim Anti Drugs Act, 2006. (2) It extends to the whole of Sikkim. (3) It shall come into force on the date of publication in the Official Gazette. Definitions 2.
