.....Judicature at Fort William, Madras arid Bombay. {The words " and the proceeds of certain estates in the charge of the Administrator General of Bengal " rep. by Act 24 of 1867, and the words " and in the Supreme Court of the Straits Settlements " rep. by Act 16 of 1874, section 2 and Schedule., Pt. I.} WHEREAS it is expedient that certain securities and sums of money deposited in the High Courts of Judicature at Fort William, Madras and Bombay, {The words " and in the Supreme Court of the Straits Settlements " rep. by Act 16 of 1874, section 2 and Schedule., Pt.I} in the course of suits in the said Courts or in the late Supreme Courts at Calcutta, Madras and Bombay, respectively, and now or hereafter appearing to have been in such deposit for a period of twenty years or upwards, without any claim thereto having been made and allowed during that period, should be transferred and paid to the Government of India for the general purposes of Government; {The second cl. of the preamble rep. by Act 12 of 1876, section. 1 and Schedule., Pt.} It is hereby enacted as follows:-

Title: Unclaimed Dead Bodies to Be Used for Therapeutic Purpose or Anatomical Examination

.....dies in such hospital and his body is unclaimed, the authorities in charge of such hospital shall with the least practicable delay report the fact to the authorized officer and such officer shall then hand over the unclaimed body to the authorities in charge of an approved institution 3[for any therapeutic purpose or] 4[for the purposes of medical education or research including] anatomical examination and dissection. (2) Where a person dies at a hospital other than a hospital referred to in sub-section (1) or in a prison and his body is unclaimed, the authorities in charge of such hospital or prison shall with the least practicable delay report the fact to the authorized officer, and the said officer shall hand over the unclaimed body to the authorities in charge of an approved institution for the purpose specified in sub-section (1). (3) Where a person having no permanent place of residence in the area where his death has taken place dies in any public place in such area and his body is unclaimed, the authorized officer shall take possession of the body and shall hand it over to the authorities in charge of an approved institution for the purpose specified in.....

The present opportunity has been taken to remedy a defect in the existing law regarding unclaimed estates in the hands of the Administrator General of Bengal. .....the prescribed time, the authority in charge of such hospital or prison or any police officer shall, with the least practicable delay report the fact to the authorised officer and the said officer shall take possession of the unclaimed body and except in the case referred to in sub-section (3), hand it over to the authority in charge of an approved institution, if it is required by that authority, for the purpose of conducting anatomical examination and dissection or other similar purpose. .....or (b) the consignment released from detention made under sub-section (1) of section 83; or (c) any remaining part of the consignment under sub-section (2) of section 83, such consignment shall be treated as unclaimed. (2) The railway administration may,-- (a) in the case of an unclaimed consignment which is perishable in nature, sell such consignment in the manner provided in clause (a) of sub-section (2) of section 83; or (b) in the case of an unclaimed consignment which is not perishable in nature, cause a notice to be served upon the consignee if his name and address are known, and upon the consignor if the name and address of the consignee are not known, requiring him to remove the goods within a period of seven days from the receipt thereof and if such notice cannot be served or there is a failure to comply with the requisition in the notice, sell such consignment in the manner provided in clause (b) of sub-section (2) of section 83. (3) The railway administration shall, out of the sale proceeds received under sub-section (2), retain a sum equal to the freight and other charges including expenses for the sale due to it and the surplus, if any, of such sale.....

Any money paid to the Commissioner1[which remains undisbursed or unclaimed for a period of three years from the day on which the last order for disbursement was made] shall be transferred by the Commissioner to the general revenue account of the Central Government; but a claim to any money so transferred may be preferrd to the Central Government by the person entitled to such payment and shall be dealt with as if such transfer had not been made, the order, if any, for payment of the claim being treated as an order for the refund of revenue. ________________________ 1.
