Insurance Regulatory and Development Authority Act, 1999 Complete Act

.....thereto and further to amend the Insurance Act, 1938, the Life Insurance Corporation Act, 1956 and the General Insurance Business (Nationalisation) Act, 1972. Be it enacted by Parliament in the Fiftieth Year of the Republic of India as follows: STATEMENT OF OBJECTS AND REASONS 1. The insurance industry requires a high degree of regulation. The Insurance Act, 1938 provides for the institution of the Controller of Insurance to act as a strong and powerful supervisory and regulatory authority with powers to direct, advise, caution, prohibit, investigate, inspect, prosecute, search, seize, fine, amalgamate, authorise, register and liquidate insurance companies. However, after the nationalisation of the life insurance industry in 1956 and the general insurance industry in 1972, the role of the Controller of Insurance diminished in significance over a period of time. 2. In April, 1993, the Government set up a high-powered Committee headed by Shri R.N. Malhotra, former Governor, Reserve Bank of India, to examine the structure of the insurance industry and recommend changes to make it more efficient and competitive keeping in view the structural changes in other parts of the financial.....

.....the purposes of that sub-section, be deemed to be liable for that act in the same manner and to the same extent as the person who has committed the act, unless he proves that the act was committed without hi s consent or connivance and was not facilitated by any neglect or omission on hi s part. Short Title Extent and commencement. (1) This Act may be called "The Mizoram State Agricultural Produce Marketing (Development and Regulation) Act. 2008". (2) It extends to the whole of Mizoram except the Autonomous District Council areas. (3) It shall come into force on such date as the State Government may, by notification, appoint. 2. Definitions. In this Act, unless the context otherwise requires:- (1) "Agricultural Produce" means all produce and commodities, whether processed or unprocessed, of agriculture, horticulture, apiculture, sericulture, livestock and products of livestock, fleeces (raw wool) and skins of animals, forest produce etc. as are specified in the schedule or declared by the Government by notification from time to time and also includes a mixture.....

Insurance Act, 1938 (4 of 1938) Section 110G

Title: Constitution of Consultative Committee

( 1 ) The Central Government shall constitute a Consultative Committee consisting of the1[Chairperson of the Authority] (who shall be the Chairman thereof) and not more than four other me mbers having special knowledge and experience of the business of insurance. ( 2 ) The term of office of, and the allowances payable to the me mbers of the Consultative Committee, the procedure to be followed by, and the quorum necessary for the transaction of business of, the Consultative Committee and the manner of filling casual vacancies therein shall be such as may be prescribed. ( 1 ) Any person aggrieved by any order made by the1[Authority]2[under sections 27 D,] 34 , 34 A, 34B , 34 C, 34 E, 34 F, 34 G, sub-sections ( 1 ), ( 4 ) and ( 7 ) of section 64 UM or section 64 VC may, within a period of thirty days from the date of such order prefer an appeal against such order to the Central Government and that Government may, by order, confirm, modify or reverse the order made by the1[Authority] and the order so made by the Government shall be final. ( 2 ) No claim for compensation shall lie in favour of any person for anything done in pursuance of an order of the Controller so long as such order was effective.
