THE SCHEDULED CASTES AND SCHEDULED TRIBES ORDERS (AMENDMENT) ACT, 2002 [Act, No. 10 of 2003] [7th January, 2003] PREAMBLE An Act to provide for the inclusion in the lists of Scheduled Tribes, of certain tribes or tribal communities or parts of or groups within tribes or tribal communities, equivalent names or synonyms of such tribes or communities, removal of area restrictions and bifurcation and clubbing of entries; imposition of area restriction in respect of certain castes in the lists of Scheduled Castes, and the exclusion of certain castes and tribes from the lists of Scheduled Castes and Scheduled Tribes, in relation to the States of Andhra Pradesh, Arunachal Pradesh, Assam, Bihar, Goa, Gujarat, Himachal Pradesh, Jharkhand, Karnataka, Kerala, Madhya Pradesh, Maharashtra, Manipur, Mizoram, Orissa, Sikkim,Tamil Nadu, Tripura, Uttar Pradesh and West Bengal: BE it enacted by Parliament in the Fifty-third Year of the Republic of India as follows.--

Title: Recognitionof, and Vesting Of, Forest Rights in Forest Dwelling Scheduled Tribes and Othertraditional Forest Dwellers

.....and verification procedure is complete. (6) Where the forest rights recognised and vested by sub-section (1) are in respect of land mentioned in clause (a) of sub-section (1) of section 3 such land shall be under the occupation of an individual or family or community on the date of commencement of this Act and shall be restricted to the area under actual occupation and shall in no case exceed an area of four hectares. (7) The forest rights shall be conferred free of all encumbrances and procedural requirements, including clearance under the Forest (Conservation) Act, 1980 (69 of 1980), requirement of paying the 'net present value' and 'compensatory afforestation' for diversion of forest land, except those specified in this Act. (8) The forest rights recognised and vested under this Act shall include the right of land to forest dwelling Scheduled Tribes and other traditional forest dwellers who can establish that they were displaced from their dwelling and cultivation without land compensation due to State development interventions, and where the land has not been used for the purpose for which it was acquired within five years of the said acquisition.

Title: Forestrights of Forest Dwelling Scheduled Tribes and Other Tradional Forest Dwellers

.....forest dwellers, as the case may be, which are not mentioned in clauses (a) to (k) but excluding the traditional right of hunting or trapping or extracting a part of the body of any species of wild animal; (m) right to in situ rehabilitation including alternative land in cases where the Scheduled Tribes and other traditional forest dwellers have been illegally evicted or displaced from forest land of any description without receiving their legal entitlement to rehabilitation prior to the 13th day of December, 2005. (2) Notwithstanding anything contained in the Forest (Conservation) Act,1980 (69 of 1980), the Central Government shall provide for diversion of forest land for the following facilities managed by the Government which involve felling of trees not exceeding seventy-five trees per hectare, nemely:-- (a) schools; (b) dispensary or hospital; (c) anganwadis; (d) fair price shops; (e) electric and telecommunication lines; (f) tanks and other minor water bodies; (g) drinking water supply and water pipelines; (h) water or rain water harvesting structures; (i) minor irrigation canals; (j) non-conventional source of energy; (k) skill upgradation or.....

.....of the Commission. (2) The Administrative expenses of the commission including the salary and allowances payable to the Chairperson, allowance payable to members and salary and allowance payable to the Officers and employees of the Commission shall be paid out of the grants referred to in Section 11. Section 6 - Vacancies etc., not to invalidate proceedings of the Commission No act or proceedings of the Commission shall be invalid merely on the ground of the existence of any vacancy in the office of membership of the commission or defect in the Constitution of the Commission. Section 7 - Procedure to be regulated by the Commission (1) The Commission shall meet as and when necessary, ordinarily at Bangalore and at such places as the Chairperson may think fit. (2) The Commission shall have power to regulate its own procedure. (3) All orders and decisions of the Commission shall be authenticated by the Member Secretary or any other officer of the Commission duly authorised by the Member Secretary in this behalf.

Title: Constitution of the Commission for the Scheduled Castes and the Scheduled Tribes

(1) The State Government shall, as soon as may be after the commencement of the Act constitute a body to be called as the Karnataka State Commission for the Scheduled Castes and the Scheduled Tribes to exercise the powers and perform the functions assigned to it by or under this Act with its head quarters at Bangalore. (2)The Commission shall consist of the following members, namely:-- (a) the Chairperson, who has special knowledge in matter relating to the Scheduled Castes and the Scheduled Tribes nominated by the State Government; (b) two persons, who have special knowledge in matters relating to the Scheduled Castes and the Scheduled Tribes nominated by the State Government; (c) The Director, Social Welfare or Director Tribal Welfare shall be the Member Secretary of the Commission respectively in matters pertaining to the Scheduled Castes and the Scheduled Tribes.
