Title: Of the Collection of Drift and Stranded Timber

Title: Collection of Drift and Stranded Timber

.....as a depot for the reception of drift timber. (3)The State Government may, by notification, exempt any class of timber from theprovisions of this section. Section 54 - Notice to claimants of drift timber Public notice shall from time to time be given by the Forest Officer, of timber collected under section 53. Such notice shall contain a description of the timber and shall require any person claiming the same to present to such officer, within a period of not less than thirty days from the date of such notice a written statement of such claim. Section 55 - Procedure on claim preferred to such timber (1) When any such statement is presented under section 54, the Forest Officer may, after making such inquiry as he thinks fit, either reject the claim after recording his reasons for so doing, or accept the claim and deliver the timber to the claimant. (2) If such timber is claimed by more than one person, the Forest Officer may either deliver the same to any of such persons whom he deems entitled thereto or may refer the claimants to the civil court, and retain the timber or wood pending the receipt of an order from any such court for its disposal. .....refuses or is unable to produce licence or documents or willfully refuses or fails to give such information which under the provisions of this Act or the rules made thereunder he is required to produce or to give, or otherwise furnishes information which he knows or believes to be false or does not believe to be true; or (ii) forcibly resists arrest or attempts to evade arrest or obstructs any Forest or Police Officer to enter or search or to effect arrest or seizure under the powers conferred by this Act or the rules made thereunder; shall be guilty of an offence against this Act, and he shall, on conviction, be punished with fine which may extend to one thousand rupees or with imprisonment for a term which mat extend to six months or with both. 15. Title: Control of Timber and Other Forest Produce in Transit

.....limit the number of such marks that may be registered by any one person and provide for the levy of fees for such registration. Title: Power to Make Rules as to Timber Cargo

State: Central

Year: 1958

Loading Of Timber (1) The Central Government shall, subject to the condition of previous publication, make rules (hereafter in this section referred to as the timber cargo rules) as to the conditions on which timber may be carried as cargo in any uncovered space on the deck of any Indian ship. (2) The timber cargo rules may prescribe a special load line to be used only when the ships carrying timber as cargo on deck and the conditions on which such special load line may be assigned, and may further prescribe either generally or with reference to particular voyages and seasons the manner and position in which such timber is to be stowed and the provisions which are to be made for the safety of the crew. (3) Any surveyor may at any reasonable time, inspect any Indian ship carrying a timber as cargo in any uncovered space on her deck for the purpose of seeing whether the timber cargo rules have been complied with. (4) The foregoing provisions of this section and the timber cargo rules shall apply to ships other than Indian ships while they are within Indian jurisdiction as they apply to Indian ships.

Title: Of the Duty on Timber and Other Forest-produce

Indian Forest Act, 1927 Section 45

Title: Certain Kinds of Timber to Be Deemed Property of Government Until Title Thereto Proved, and May Be Collected Accordingly

(1) All timber found adrift, beached, stranded or sunk; all wood or timber bearing marks which have not been registered in accordance with the rules made under section 41, or on which the marks have been obliterated, altered or defaced by fire or otherwise; and in such areas as the1[State Government] directs, all unmarked wood and timber, shall be deemed to be the property of Government, unless and until any person establishes his right and title thereto, as provided in this Chapter. (2) Such timber may be collected by any Forest-officer or other person entitled to collect the same by virtue of any rule made under section 51 and may be brought to any depot which the Forest-officer may notify as a depot for the reception of drift timber. Forest Act, 1963 Section 53

Title: Certain Kinds of Timbers to Be Deemed Property of State Government Until Title Thereto Proved

(1) All timber found adrift, beached stranded or sunk; all woodor timber bearing marks which have not been registered in accordance with therules made under section 50 or which have been supermarked or on which themarks have been obliterated, altered or defaced by fire or otherwise; and insuch areas as the State Governmentdirects, all unmarked wood and timber; shall be deemed to be the property ofthe State Government unless and until any person establishes his right andtitle thereto, as provided in this Chapter. (2)The timber referred to in sub-section (1) may be collected by any ForestOfficer or other person entitled to collect the same by virtue of any rule madeunder section 59 and may be brought to any depot which the Forest Officer maynotify as a depot for the reception of drift timber.
