.....A person who is found to be on any vacant land belonging to, or vesting in, another person shall, unless the contrary is proved by him to the satisfaction of the Competent Authority, be deemed to be in occupation of such vacant land in contravention of the provisions of section, 3. SECTION 05: PENALTY (1) Any person who contravenes the provisions or subsection (1) of section 3 or who fails to comply with my order made by the Competent Authority under section 4 or obstructs the Competent Authority in the lawful exercise of any power conferred by or under this Act shall, on conviction, be punished with imprisonment for a term which may extend to three years and with two. (2) Any person who contravenes the provisions of sub-section (2) of section 3 shall, on conviction, be punished with imprisonment for a period which may extend to three years and fine: Provided that in the absence of special and adequate reason to the contrary to be mentioned in the judgment of the Court, such imprisonment shall not be less than six months, and fine shall not be less than five hundred rupees.
