THE LIVE-STOCK IMPORTATION (AMENDMENT) ACT, 1953 [Act, No. 40 of 1953] [16th December, 1953] PREAMBLE An Act further to amend the Live-Stock Importation Act, 1898. BE it enacted by Parliament as follows-- 1. Short title.-- This Act may be called the Live-stock Importation (Amendment) Act, 1953. 2. Amendment of section 1, Act IX of 1898.-- In section 1 of the Live-stock Importation Act, 1898 (hereinafter referred to as the principal Act), for sub-section (2), the following sub-section shall be substituted, namely:-- "(2) It extends to the whole of India except the State of Jammu and Kashmir.". 3. Amendment of section 2, Act IX of 1898.-- In this section 2 of the principal Act, after clause (b), the following clause shall be inserted, namely:-- "(c) 'import' means the bringing or taking, by sea, land or air, into the territories to which this Act extends.". 4. Amendment of section 3, Act IX of 1898.-- In section 3 of the principal Act, in sub-section(1), for the words "the bringing or taking, by sea or land", the words "the import" shall be substituted.

.....may direct that a breach thereof shall be punishable with fine which may extend to one thousand rupees. SECTION 05: PROTECTION TO PERSONS ACTING UNDER ACT No suit, prosecution or other legal proceeding shall lie against any person for anything in good faith done or intended to be done under this Act. .....of split Where a councillor or a member makes a claim that he and any other members of his political party constitute the group representing a faction which has arisen as a result of a split in his political party and such group consists of not less than one--third of the members of such political party,-- (a) he shall not be disqualified under sub--section (1) of section 3 on the ground,-- (i) that he has voluntarily given up his membership of his political party ; or (ii) that he has voted or abstained from voting in, or intentionally remained absent from, any meeting of the Municipal Corporation, Municipal Council, Town Panchayat, Zilla Panchayat or Taluk Panchayat contrary to any direction issued by the political party to which he belongs or by any person or authority authorised by it in this behalf, without obtaining in any case, the prior permission of such political party, person or authority and such voting or abstention or absence has not been condoned by such political party, person or authority within fifteen days from the date of voting or such abstention or absence ; and (b) from the time of such split, such faction shall be deemed to be the political.....

.....auction or sent to a pinjrapol: provided that if the owner of the said bull appears within fifteen days of such seizure and proves to the satisfaction of the live-stock officer that the said bull is of his ownership," the said bull" (i) if not sold by public auction, or (ii) if sent to a pinjrapol, shall be delivered to such owner on payment of the costs, charges and expenses incurred for the maintenance of the said bull and determined in the prescribed manner, or (iii) if sold by public auction, the proceeds of such sale shall be paid to such owner after deducting therefrom the costs, charges and expenses incurred for the maintenance and sale of the said bull and determined in the prescribed manner. SECTION 17: POWER OF LIVE STOCK OFFICER TO INSPECT OR MARK A BULL OR TO ENTER PREMISES For the purposes of this Act, a live stock officer shall have power at all reasonable times" (a) to inspect any bull, (b) to mark any bull with any prescribed mark in the prescribed manner, (c) to enter any premises or other place in the prescribed manner where he has reason to believe that a bull is kept.
