Smith, Stanistreet and Company Limited (Acquisition and Transfer of Undertakings) Act, 1977 Chapter III

Title: Payment of Accounts

.....of ten thousand rupees per annum for the period commencing on the date on which the management of the undertakings of the Company was taken over by the Central Government and ending on the appointed day. (2) The amount specified in section 7 and the amount determined under sub-section (1) shall carry simple interest at the rate of four per cent.per annum for the period commencing on the appointed day and ending on the date on which the payment of the amount is made by the Central Government to the Commissioner. (3) The amount determined in accordance with the provisions of sub-sections (1) and (2) shall be given by the Central Government to the Company in addition to the amount specified in section 7. (3) For the removal of doubts, it is hereby declared that the liabilities of the Company in relation to its undertakings which have vested in the Central Government under section 3, shall be discharged from the amount referred to in section 7, and also from the amounts determined under sub-sections (1) and (2), in accordance with the rights and interests of the creditors of the Company.

.....41 of 1977 17th December 1977 STATEMENT OF OBJECTS AND REASONS Messrs. Smith, Stanistreet and Company Limited, Calcutta were engaged in the manufacture of drugs and pharmaceuticals which were essential to the needs of the country. The Company began to show steady decline in production from 1970 onwards and incurred considerable losses. The Company was also being mismanaged. After investigation into the affairs of the Company through an investigation Committee, the management of its undertakings was taken over on 4th May, 1972 by the Central Government acting under section 18A of the Industries Development and Regulation) Act. 1951. The Indian Drugs and Pharmaceuticals Ltd., a Public Sector Undertaking was appointed as authorised Controller. As the Company had to be modernised and expansion undertaken in order to ensure the augmentation and distribution of the different varieties of essential pharmaceuticals and chemicals produced; by the Company arid to ensure the continued supply thereof in public interest, it was necessary to acquire the right title and interest of the undertakings of the Company. .....hereinafter appearing; It is hereby enacted as follows: Section 1 Short title This Act may be called the Cooch Behar Municipal (Second Amendment) Act, 1962. Section 2 Amendment of section 4 of Cooch Behar Act 3 of 1944 In clause (2) of section 4 of the Cooch Behar Municipal Act, 1944 (hereinafter referred to as the said Act), for the words "ten feet", the words "three metres" shall be substituted. Section 3 Amendment of section 13 In section 13 of the said Act, (i) for sub-section (.1), the following sub-section shall be substituted, namely: "(1) The Magistrate in charge of the subdivision in which a Municipality is situated or any other Magistrate of the first or second class authorised by him in writing in this behalf shall prepare and publish at the time and in the manner prescribed an electoral roll showing the names of persons qualified to vote at an election of Commissioners."; (ii) in sub-section (5), for the words "Commissioners at a meeting" the words "Magistrate by whom the electoral rolls were prepared and published under sub-section (1)" shall be substituted; and (iii) after sub-section (5), the following sub-section shall be inserted, namely: "(6) The cost.....

Jammu and Kashmir Cancellation of Orders and Annulment of Instruments Act, 1992 Complete Act

.....of the grant of amount under Section 5. (2) Every appeal under this section shall be preferred within a period of thirty days from the date of the order. Section 7 Penalty (1) Notwithstanding anything to the contrary contained in any other law for the time being in force, no person, whose interest and rights have been extinguished under Section 3, shall enter or occupy the property. (2) Any person who contravenes the provisions of sub-section (1) shall be punished with imprisonment for a term which may extend to two years or with fine which may extend to ten thousand rupees or with both. Section 8 Eligibility for fresh allotment Nothing contained in this Act shall debar any person, whose allotment of property has been cancelled under Section 3, from applying and being considered for allotment of a plot for residential purpose by the authority in accordance with the prescribed eligibility. Section 9 Repeal and saving (1) The Jammu and Kashmir Cancellation of Orders and Annulment of Instruments Act, 1992 (Governor's Act No. V of 1990), is hereby repealed.
