EMPLOYEES' STATE INSURANCE ACT, 1948 Section 65

Title: Benefits not to be combined

State: Central

Year: 1948

(1) An insured person shall not be entitled to receive for the same period-- (a) both sickness benefit and maternity benefit; or (b) both sickness benefit and disablement benefit for temporary disablement; or (c) both maternity benefit and disablement benefit for temporary disablement. (2) Where a person is entitled to more than one of the benefits mentioned in sub-section (1), he shall be entitled to choose which benefit he shall receive.

Title: Power of Board to Borrow

.....subject to the provisions of this Act and to such conditions as may be prescribed in this behalf, borrow any sum required for the purposes of this Act. (2) Rules made by the State Government for the purposes of this section may empower the Board to borrow by the1[issue of debentures or bonds] or otherwise and to make arrangements with bankers, and may apply to the Board with such modifications as may be necessary to be consistent with this Act the provisions of the Local Authorities Loans Act, 1914 (9 of 1914) and the rules made thereunder as if the Board were a local authority. (3) The maximum amount which the Board may at any time have on loan under sub-section (1) shall be ten crores of rupees, unless the State Government, with the approval of the State Legislative Assembly, fixes a higher maximum amount. (4)2[Debentures or bonds issued] by the Board under this section shall be issued, transferred, dealt with the redeemed in such manner as may be prescribed. _________________________ 1. Bombay Children Act, 1948, (Maharashtra) Section 65

Title: Custody of Children Not Enlarged on Bail

State: Maharashtra

Year: 1948

(1) Where a boy 1[x x x] apparently under the age of sixteen years 2[or a girl apparently under the age of eighteen years] having been arrested is not released under section 64 or otherwise, the officer in-charge of the police station or section shall cause him or her to be detained in the prescribed manner until he or she can be brought before a juvenile court or a court empowered under section 8 to exercise the powers of a juvenile court. (2) A court, on remanding or committing for trial a child who is not released on bail, shall order him to be detained in the prescribed manner. ___________________ 1. Factories Act, 1948 Section 65

Title: Power to Make Exempting Orders

.....on or to other circumstances, it is unreasonable to require that the periods of work of any adult workers in any factory or class or description of factories should be fixed beforehand, it may, by written order, relax or modify the provisions of section 61 in respect of such workers therein, to such extent and in such manner as it may think fit, and subject to such conditions as it may deem expedient to ensure control over periods of work. ( 2 ) The State Government or, subject to the control of the Stale Government, the Chief Inspector may by written order exempt, on such conditions as it or he may deem expedient, any or all of the adult workers in any factory or group or class or description of factories from any or all of the provisions of sections 51 , 52 , 54 and 56 on Ike ground that the exemption is required to enable the factory or factories to deal with an exceptional press of work. 1[( 3 ) Any exemption granted under sub-section ( 2 ) shall be subject to the following conditions, namely :-- (i) the total number of hours of work in any day shall not exceed twelve; (ii) the spreadover, inclusive of intervals for rest, shall not exceed thirteen hours in any one.....

Title: Power to Examine Persons

Power to examine persons.-- The civil authority may examine any person who seeks leave to enter India or to depart therefrom or during his stay in India for the purposes of the Foreigners Act, 1946, or of any order made thereunder; and it shall be the duty of every such person to furnish to the civil authority such information in such manner and at such times, as that authority may require.] ________________________ 1. Foreigners Order, 1948 Section 5

Title: Power to Grant Permission to Depart from India

.....in India to answer a criminal charge; (c) the foreigner's departure will prejudice the relations of the Central Government with a foreign power; (d) the departure of the foreigner has been prohibited under an order issued by a competent authority. (3) (a) Notwithstanding anything contained in the above sub--paragraphs, a civil authority may prohibit the departure of a foreigner where it is satisfied that such departure would not be conducive to the public interest; (b) Whenever a civil authority issues an order under clause (a), it shall report the matter forthwith to the Central Government which may cancel or modify the order in such manner as it thinks fit. ________________________ 1. Foreigners Order, 1948 Section 4

Title: Landing of Seamen

State: Central

Year: 1948

(1) No seaman or member of the crew of an aircraft, being a foreigner, shall land in India without a special permit from the Superintendent of Police or any other Police Officer not below the rank of a Sub--Inspector or Sargent. (2) No such permit shall be granted unless the owners or agents of the vessel or aircraft have undertaken either generally in respect of all members of the crew of vessels or aircraft belonging to or managed by them or in an individual case the responsibility for the maintenance of such seaman or member of the crew during his residence in India and for the expenses of his departure from India. (3) For the purpose of this paragraph "seaman" has the meaning assigned to it in the Registration of Foreigners Rules, 19391 . (4) The provisions of this paragraph are in addition to, and not in derogation of, the provisions of paragraph 3. ________________________ 1. Now "The Registration of Foreigners Rules, 1992".

Foreigners Order, 1948 Section 3

Title: Power to Grant or Refuse Permission to Enter India

.....civil authority may attach such conditions as it thinks fit to the grant of leave to enter and such conditions may be varied in such manner or cancelled as the Central Government deems fit. (4) (a) Notwithstanding anything contained in sub--paragraphs (1) to (3) or in the Indian Passport Act, 1920 (34 of 1920), or in the rules made thereunder, a civil authority may, in the interests of public safety, prohibit the entry of any foreigner into India. (b) Whenever the civil authority issues an order under clause(a), it shall report the matter forthwith to the Central Government which may cancel or modify the order in such manner as it thinks fit. (5) Where leave to enter is refused to a foreigner, he may be detained at some place approved by the civil authority and may, if he has come by sea, be placed temporarily on shore for that purpose, and whilst he is so detaineda foreigner shall be deemed to be in legal custody and not to have entered India. ________________________ 1. In this Order--- (1) "Registration Officer" means a Registration Officer as defined in the Registration of Foreigners Rules, 19391, or such other officer as may be authorised by him to perform the functions of a Registration Officer under this Order; (2) "Civil Authority" means such authority as may be appointed by the Central Government in this behalf for such area as it thinks fit; (3) "Port" includes an airport. ______________________ 1.
