.....inviting bids shall contain the following details, namely:-- (a) name, address of registered office of the company and its branch offices, factories and plants and the place where assets of the company are kept and available for sale; (b) last date for submitting bids which shall not exceed ninety days from the date of advertisement; (c) time during which the premises of the company shall remain open for inspection; (d) the last date for withdrawing the bid; (e) financial guarantee which shall not be less than one-half of the value of the bid; (f) validity period of the bids; (g) place and date of opening of the bids in public; (h) reserve price and earnest money to be deposited along with the bid; (i) any other terms and conditions of sale which may be prescribed. (2G) The liquidator appointed shall-- (a) maintain a separate bank account for each company under his charge for depositing the sale proceeds of the assets and recovery of debts of each company; (b) maintain proper books of account in respect of all receipts and payments made by him in respect of each company and submit half yearly return of receipts and payments to the Tribunal.".

Title: Lurking House-trespass or House-breaking by Night in Order to Commit Offence Punishable with Imprisonment

.....court may, for adequate and special reasons to be me ntioned in the judgment, impose a sentence of imprisonment for a term of less than three years". 2[ State of Uttar Pradesh Amendment of section 457 - section 457 of the principal Act shall be renumbered as sub­section (I) of that section and after sub section ( 1 ) as so renumbered, the following sub-section shall be added namely-- ( 2 ) Whoever commits lurking house trespass by night or house breaking by night in any building used as a place of worship in order to the committing of the offence of theft of any idol or icon from such buildings shall notwithstanding any thing contained in sub-section ( 1 ) be punished with rigorous imprisonment which shall not be less than three years but which may extend to fourteen years and with fine which shall not be less than five thousand rupees: Provided that the court may, for adequate and special reasons to be me ntioned in the judgment, impose a sentence of imprisonment for a term of less than three years. _________________ 1. Code of Criminal Procedure (Amendment) Act, 2005 Section 13

Title: Amendment of Section 102

In section 102 of the principal Act,-- (a) in sub-section (3), after the words "transported to the Court", the words "or where there is difficulty in securing proper accommodation for the custody of such property, or where the continued retention of the property in police custody may not be considered necessary for the purpose of investigation" shall be inserted; (b) after sub-section (3), the following proviso shall be added at the end, namely:-- "Provided that where the property seized under sub-section (1) is subject to speedy and natural decay and if the person entitled to the possession of such property is unknown or absent and the value of such property is less than five hundred rupees, it may forthwith be sold by auction under the orders of the Superintendent of Police and the provisions of sections 457 and 458 shall, as nearly as may be practicable, apply to the net proceeds of such sale.".

Code of Criminal Procedure, 1973 Section 459

Title: Power to Sell Perishable Property

If the person entitled to the possession of such property is unknown or absent and the property is subject to speedy and natural decay, or if the Magistrate to whom its seizure is reported is of opinion that its sale would be for the benefit of the owner, or that the value of such property is1[less than five hundred rupees], the Magistrate may at any time direct it to be sold; and the provisions of sections 457 and 458 shall, as nearly as may be practicable, apply to the net proceeds of such sale. ____________________________________________ 1. Title: Police to Take Charge of Unclaimed Property

Section 75 - Police to take charge of unclaimed property 1[(1)] The police shall take temporary charge,-- (a) of all unclaimed property found by or made over to them; and (b) of all property found lying in any public street, if the owner or person in charge of such property on being directed to remove the same, refuses or omits to do so. 2[(2) The taking of temporary charge of any property under sub-section (1) shall be forthwith reported to a Judicial Magistrate and the procedure laid down in sections 457, 458 and 459 of the Code of Criminal Procedure 1973, shall be applicable in respect of the disposal of such property as if it were property seized by a Police Officer under the said Code.] _______________________________ 1. Title: Order for Disposal of Property at Conclusion of Trial

.....to be entitled to the possession thereof, without any condition or on condition that he executes a bond with or without sureties, to the satisfaction of the Court, engaging to restore such property to the Court if the order made under sub-section (1) is modified or set aside on appeal or revision. (3) A Court of Session may, instead of itself making an order under sub-section (1), direct the property to be delivered to the Chief Judicial Magistrate, who shall thereupon deal with it in the manner provided in sections 457, 458 and 459. (4) Except where the properly is livestock or is subject to speedy and natural decay, or where a bond has been executed in pursuance of sub-section (2), an order made under sub-section (1) shall not be carried out for two months, or when an appeal is presented, until such appeal has been disposed of. (5) In this section, the term "property" includes, in the case of properly regarding which an offence appears to have been committed, not only such property as has been originally in the possession or under the control of any party, but also any property into or for which the same may have been converted or exchanged, and anything acquired.....
