Title : Penalty for Contravention of Section 23

Whoever, being required by section 23 to maintain any record or register, omits or fails to do so, or being required by an Inspector to produced any records or registers for his inspection, omits or fails to do so, shall be punished with fine which may extend to one thousand rupees, and, for the second or subsequent offence, with imprisonment for a term which may extend to one year and also with fine.

.....writing suspend or cancel any such licence. (3) Before suspending or cancelling a licence under sub-section (2), the prescribed authority shall give notice to the licensee stating the grounds on which it is proposed to suspend or cancel his licence and give him a reasonable opportunity of showing cause against it. (4) After considering the explanations, if any, of the licensee, the prescribed authority may pass such orders as it deems just. (5) The holder of any such licence shall, on the expiry thereof or the receipt of an order suspending or cancelling it, return the licence to the prescribed authority. (6) Where a licence granted to a weigher, sampler or grader is lost, destroyed, torn, defaced or otherwise becomes illegible, the prescribed authority shall issue a duplicate licence on the application of the weigher, sampler or grader, as the case may be, and on payment of the prescribed fee.

Title : Appeal Against Notice Served Under Sub-section (1) of Section 23

Where the person on whom notice to remove an encroachment has been served under sub-section (1) of section 23 lays claim that the land in respect of which encroachment has been alleged is his property or that he has acquired a right over it by virtue of adverse possession or otherwise he shall, within the time limit prescribed in the notice for the removal of encroachment, file an appeal before the Deputy Commissioner under intimation to the Highway Authority or the officer authorised under sub-section (1) of section 21, as the case may be. The Deputy Commissioner shall, after due enquiry, record his decision in writing and communicate the same to the appellant and the Highway Authority or such officer. The Highway Authority or such officer shall till then desist from taking further action in the matter.
