Title: Determination of Certain Contracts

(1) Any contract for the sale or lease of a patented article or for licence to manufacture, use or work a patented article or process, or relating to any such sale, lease or licence,1[***], may at any time after the patent or all the patents by which the article or process was protected at the time of the making of the contract has or have ceased to be in force, and notwithstanding anything to the contrary in the contract or in any other contract, be determined by the purchaser, lessee, or licensee, as the case may be, of the patent on giving three months, notice in writing to the other party. (2) The provisions of this section shall be without prejudice to any right of determining a contract exercisable apart from this section. ________________________ 1. (1) This Act may be called the Indian Soldiers (Litigation) Act, 1925. Title: Repeal of Act 2 of 1911 in So Far as It Relates to Patents and Savings

.....of this Act, may be continued and disposed of, as if this Act had not been passed. __________________________ 1. Sub-section(2) and (3) omitted by Patents (Amdt) Act, 2002. dated 25.06.2002 w.e.f 20.05.2003. .....1911 (2 of 1911) thereafter in this section referred to as the repealed Act), and, consequently, was deemed to have been refused by reason of sub-section (4) of section 5 of the repealed Act, the application may, if the applicant or, if he is dead his legal representative makes a request in that behalf to the Controller in the prescribed manner within three months from the commencement of this Act, be revived and shall be disposed of as if it were an application pending at the commencement of this Act to which the provisions of this Act apply by reason of sub-section (3) of section 162. Title: Rules to Be Placed Before Parliament

Every rule made under this Act shall be laid, as soon as may be after it is made, before each House of Parliament while it is in session for a total period of thirty days which may be comprised in one session or1[in two or more successive sessions, and if, before the expiry of the session immediately following the session or the successive sessions aforesaid], both Houses agree in making any modification in the rule or both Houses agree that the rule should not be made, the rule shall thereafter have effect only in such modified form or be of no effect, as the case may be; so, however, that any such modification or annulment shall be without prejudice to the validity of anything previously done under that rule. __________________________ 1. Title: Protectionof Security of India

.....prejudicial to the interest of security of India; (b) take action including the revocation of any patent which it considers necessary in the interest of security of India: Provided that the Central Government shall, before taking any action under this clause, issue a notification in the Official Gazette declaring its intention to take such action.
