Title: Theft by Clerk or Servant of Property in Possession of Master

Year: 1860
Whoever, being a clerk or servant, or being employed in the capacity of a clerk or servant, commits theft in respect of any property in the possession of his master or employer, shall be punished with imprisonment of either description for a term which may extend to.seven years, and shall also be liable to fine.

Title: Arrest of Offenders

(1) Any police officer, may arrest any person who commits in his view any offence against this Act or against any rule, regulation or bye-law made thereunder if-- (a) the name and address of such person be unknown to him, and (b) such person on demand declines to give his name and address or gives a name and address which such officer has reason to believe to be false. (2) No person so arrested shall be detained in custody after his true name and address are ascertained or, without the order of the nearest magistrate for a period longer than twenty-four hours from the time of arrest exclusive of the time necessary for the journey from the place of arrest to the court of such magistrate.

Title: Butcher's, fishmonger's and poulterer's licence

(1) No person shall, without or otherwise than inconformity with a licence from the Commissioner, carry on the trade of a butcher, fishmonger or poulterer or use any place for the sale of fresh fish or poultry intended for human food,- (a) in any place within the limits of the city; (b) in any place within five kilometers of such limits and not included in any municipality constituted under the Karnataka Municipalities Act, 1964 (Karnataka Act 22 of 1964): Provided that no licence shall be required for a place used for the selling or storing for sale of presented flesh of fish contained in air-tight and hermetically sealed receptacles. (2) The Commissioner may by order and subject to such restrictions as to supervision and inspection as he thinks fit grant or refuse to grant such licence. (3) Every such licence shall expire at the end of the year for which it is granted or at such earlier date as the Commissioner may, for special reasons, specify in the licence.

Title: Power of Central Government to Cancel or Suspend Other Certificates

Notwithstanding anything contained in this Act, the Central Government may, at any time, without any formal investigation or inquiry, cancel or suspend any certificate granted by it under this. Act, other than a certificate granted to a master, mate or engineer, if, in its opinion, the holder is, or has become, unfit to act in the grade for which the certificate was granted to him: Provided that no order under this section shall be passed by the Central Government unless the person concerned has been given an opportunity of making a representation against the order proposed.

Subject to the provisions of this Part, the certificate of the District Judge shall, with respect to the debts and securities specified therein, be conclusive as against the persons owing such debts or liable on such securities, and shall, notwithstanding any contravention of section 370, or other defect, afford full indemnity to all such persons as regards all payments made, or dealings had, in good faith in respect of such debts or securities to or with the person to whom the certificate was granted.

Title: Appeal to Court of Session How Heard

(1) Subject to the provisions of subsection (2), an appeal to the Court of Session or Sessions Judge shall be heard by the Sessions Judge or by an Additional Sessions Judge: Provided that an appeal against a conviction on a trial held by a Magistrate of the second class may be heard and disposed of by an Assistant Sessions Judge or a Chief Judicial Magistrate. (2) An Additional Sessions Judge, Assistant Sessions Judge or a Chief Judicial Magistrate shall hear only such appeals as the Sessions Judge of the division may, by general or special order, make over to him or as the High Court may, by special order, direct him to hear.

Title: Accounts of Foreign Company

(1) Every foreign company shall, in every calendar year,-- (a) make out a balance sheet and profit and loss account in such form, containing such particulars and including or having annexed or attached thereto such documents as may be prescribed; and (b) deliver a copy of those documents to the Registrar: Provided that the Central Government may, by notification, direct that, in the case of any foreign company or class of foreign companies, the requirements of clause (a) shall not apply, or shall apply subject to such exceptions and modifications as may be specified in that notification. (2) If any such document as is mentioned in sub-section (1) is not in the English language, there shall be annexed to it a certified translation thereof in the English language. (3) Every foreign company shall send to the Registrar along with the documents required to be delivered to him under sub-section (1), a copy of a list in the prescribed form of all places of business established by the company in India as at the date with reference to which the balance sheet referred to in sub-section (1) is made out.

(3) Subject to any notification issued under sub-section (1), everymunicipal body referred to in the said sub-section which is, - (i) a city municipal council, a borough2[municipal area] or a town committee, shall, as from the date of commencement of this Act, exercise the powers and perform the duties conferred by the provisions of this Act on a city municipal council, until a city municipal council is duly constituted for the area within the jurisdiction of such body under the provisions of this Act; (ii) a body other than a body referred to in clause (i) shall, as from the date of commencement of this Act, exercise the powers and perform the duties conferred by the provisions of this Act on a town municipal council, until a town municipal.....

Title: Officers and Employees of National Tax Tribunal

(1) The Central Government shall provide the National Tax Tribunal with such officers and employees as it may deem fit. (2) The salaries and allowances and other conditions of service of officers and employees of the National Tax Tribunal shall be such as may be prescribed. (3) The officers and employees of the National Tax Tribunal shall discharge their functions under the general superintendence of the Chairperson. (4) The officers and the other employees shall be appointed on the recommendations of a Selection Committee constituted by the Central Government.
