THE INTEREST ON DELAYED PAYMENTS TO SMALL SCALE AND ANCILLARY INDUSTRIAL UNDERTAKINGS ACT, 1993 [Act, No. 32 of 1993] [2nd April, 1993] PREAMBLE An Act to provide for and regulate the payment of interest on delayed Payments to small scale and ancillary industrial undertakings and for matters connected therewith or incidental thereto. .....to such dispute as if the arbitration or conciliation were pursuant to an arbitration agreement referred to in subsection (1) of Section 7 of that Act." ] SECTION 06: LIABILITY OF BUYER TO PAY COMPOUND INTEREST 4 SECTION 07: APPEAL No appeal against any decree, award or other order shall be entertained by any Court or other authority unless the appellant (not being a supplier) has deposited with it seventy-five per cent of the amount interms of the decree, award or, as the case may be, other order in the manner directed by such Court or, as the case may be, such authority. SECTION 07A: ESTABLISHMENT OF INDUSTRY FACILITATION COUNCIL 6The State Government may, by notification in the Official Gazette, establish one or more Industry Facilitation Councils at such places exercising such jurisdiction and for such areas, as may be specified in the notification. SECTION 07B: COMPOSITION OF INDUSTRY FACILITATION COUNCIL 7 (1) The Industry Facilitation Council shall consist of one or more members to be appointed from amongst the following categories:- (i) Director of Industries by whatever name called or any other officer not below the rank of such Director, of the State Government; (ii).....

Title: Deduction in Respect of Profits and Gains from Newly Established Small-scale Industrial Undertakings in Certain Areas

(2) This section applies to any small-scale industrial undertaking which fulfils all the following conditions, namely : (i) it begins to manufacture or produce articles after the 30th day of September, 1977, but before the 1st day of April, 1990, in any rural area ; (ii) it is not formed by the splitting up, or the reconstruction, of a business already in existence : Provided that this condition shall not apply in respect of any small-scale industrial undertaking which is formed as a result of the re-establishment, reconstruction or revival by the assessee of the business of any such industrial undertaking as is referred to in section 33B, in the circumstances and within the period specified in that section ; (iii) it is not formed by the transfer to a new business of machinery or plant previously used for any purpose ; (iv) it employs ten or more workers in a manufacturing process carried on with the aid of power, or employs twenty or more workers in a manufacturing process carried on without the aid of power. Explanation : Where in the case of a small-scale industrial undertaking, any machinery or plant or any part thereof previously used for any purpose is.....

Bombay Agricultural Debtors Relief Act, 1947, (Maharashtra) Section 31

Title: Debts Payable by Debtors to Be Scaled Down

(1) Notwithstanding any law, custom, contract, award or decree of a Court to the contrary the amounts found due under section 22 from a debtor shall be further scaled down in the manner hereinafter provided. (2) If all the debts found due by a debtor after taking accounts under section 22 are unsecured, such debts shall be further scaled down pro rata to the paying capacity of the debtor. (3) If all the debts found due by after taking accounts under section 22, are secured debts, and the total amount of such debts is more than sixty per cent. of the value of the property belonging to the debtor, such debts shall be, further scaled down pro rata to the paying capacity of the debtor. (4) If the debts found due by a debtor after taking accounts under section 22 are both secured and unsecured, and if the total amount of the secured debts is more than sixty per cent of the value of the property on which such debts are secured, the secured debts shall be further scaled down pro rata to sixty per cent. of the value of other the property on which such debts are secured and the unsecured debts shall be further scaled down pro rata to sixty per cent. of the value of the other.....

Title: Power of Central Government to Specify the Requirements Which Shall Be Complied with by Small Scale Industrial Undertakings

.....and control of the material resources of thecommunity are so distributed as best to subserve the common good, specify,having regard to the factors mentioned in sub-section (2), by notified order,the requirements which shall be complied with by an industrial undertaking toenable it to be regarded, for the purposes of this Act, as an ancillary, or asmall scale, industrial undertaking and different requirements may be sospecified for different purposes or with respect to industrial undertakingsengaged in the manufacture or production of different articles : Providedthat no industrial undertaking shall be regarded as an ancillary industrialundertaking unless it is, proposed to be, engaged in-- (i)the manufacture of parts, components, sub-assemblies, toolings or intermediates; or (ii)rendering of services, or supplying or rendering, not more than fifty per. cent,of its production or its total services, as the case may be, to other units forproduction of other articles. (2)The factors referred to in sub-section (1) are the following, namely: (a)the investment by the industrial undertaking in-- (i)plant and machinery, or (ii)land, buildings, plant and machinery ;.....

459.1Power to constitute committees to advise on rules, regulations and scales of fees (1) The Central Government may, if it thinks fit, constitute one or more committees consisting of such number of persons as it may appoint thereto representing the interests principally affected or having special knowledge of the subject-matter, for the purpose of advising it when considering the making or alteration of any rules, regulations or scales of fees under this Act or for any other purpose connected with this Act. (2) There shall be paid to the members of any such committee such travelling and other allowances as the Central Government may fix. (3) Committees may be constituted under this section to advise the Central Government either generally as regards any rules, regulations or scales of fees or as regards any class or classes of rules, regulations or scales of fees in particular or for any other purpose connected with this Act. ________________________ 1. Bombay Agricultural Debtors Relief Act, 1947, (Maharashtra) Section 34

Title: No Recovery of Amount in Excess of Debts Scaled Down

The amount of debts scaled down under section 31 or further scaled down under section 33 shall for the purposes of this Act be the amount due by the debtor in respect of the said debts and the portion of the debts in excess of this amount shall be extinguished.
