THE KERALA PUBLIC MEN'S CORRUPTION (INVESTIGATIONS AND INQUIRIES) AMENDMENT ACT, 1992 [Act No. 4 of 1992] PREAMBLE An Act further to amend the Kerala Public Men's Corruption (Investigations and inquiries) Act, 1987. Preamble.- WHEREAS it is expedient further to amend the Kerala Public Men's Corruption (Investigations and Inquiries) Act, 1987 for the purposes hereinafter appearing; Be it enacted in the Forty-third Year of the Republic of India as follows:- Section 1 - Short title and commencement (1) This Act may be called the Kerala Public Men's Corruption (Investigations and Inquiries) Amendment Act, 1992. (2) The provisions of Ss. 3, 4, 8, 10 and 11 shall be deemed to have come into force on the 11th day of December, 1991 and the remaining provisions of this Act shall come into force at once and the reference in any such provision to the commencement of this Act shall be construed as a reference to the coming into force of that provision. Any person subject to this Act who attempts to commit any of the offences specified in sections 16 to 44 (both inclusive) and in such attempt does any act towards the commission of the offence shall, on conviction by a Force Court, where no express provision is made by this Act for the punishment of such attempt, be liable, (a) if the offence attempted to be committed is punishable with death, to suffer imprisonment for a term which may extend to fourteen years or such less punishment as is in this Act mentioned; and (b) if the offence attempted to be committed is punishable with imprisonment, to suffer imprisonment for a term which may extend to one-half of the longest term provided for that offence or such less punishment as is in this Act mentioned.

Where after taking cognizance of any offence, a Special Court is of the opinion that the dispute is not a scheduled dispute or the offence is not a scheduled offence, it shall notwithstanding that it has no jurisdiction to try the case, transfer the case for trail to any court having jurisdiction under the Code and the Court to which the case is transferred may proceed with the case as if it had taken cognizance of the offence or had been seized of the dispute.
