The Uttarakhand Agricultural Produce Marketing (Development and Regulation) Act, 2011 Complete Act

.....Warehousing Corporation" means the Central Warehousing Corporation, established or deemed to be established under the Warehousing Corporation Act, 1962 (Act No. 58, 1962); (ix) "Chief Executive Officer" means a person, appointed as such under sub-section (2) of section 36 of the Act, by Agriculture Produce Marketing Committee. (x) "Collector" means the Collector of the District, where the Principal Market Yard of the Market Area is located, and includes such other officer, as may be authorized by him in that behalf; (xi) "Commissioner" means, the Commissioner of such administrative division of the State, where the Principal Market Yard of the Market Area is located;. (xii) "Commission Agent, dalal or arhatiya" means a person, who, in the ordinary course of business, negotiates or arrange contracts for the purchase or sale of the agricultural produce, on behalf of his principal, on payment of his commission or remuneration, whether in cash or kind, but it does not include the servant of such principal, whether engaged in negotiating or arranging such contracts; (xiii) "Committee " means the Agricultural Produce Marketing Committee, constituted under this Act; .....

CHAPTER 12 OIL SEEDS AND OLEAGINOUS FRUITS, MISCELLANEOUS GRAINS, SEEDS AND FRUIT; INDUSTRIAL OR MEDICINAL PLANTS; STRAW AND FODDER NOTES 1. Heading 1207 applies, inter alia, to palm nuts and kernels, cotton seeds, castor oil seeds, sesamum seeds, mustard seeds, safflower seeds, poppy seeds and shea nuts (karite nuts). It does not apply to products of heading 0801 or 0802 or to olives (Chapter 7 or Chapter 20). 2. Heading 1208 applies not only to non-defatted flours and meals but also to flours and meals which have been partially defatted or defatted and wholly or partially refatted with their original oils. It does not, however, apply to residues of headings 2304 to 2306. 3. For the purposes of heading 1209, beet seeds, grass and other herbage seeds, seeds of ornamental flowers, vegetable seeds, seeds of forest trees, seeds of fruit trees, seeds of vetches (other than those of the species Vicia faba) or of lupines are to be regarded as "seeds of a kind used for sowing". Heading 1209 does not, however, apply to the following even if for sowing: (a) leguminous vegetables or sweet corn (Chapter 7); (b) spices or other products of Chapter 9; (c) cereals (Chapter 10);

Coconut Development Board Act,1979 Chapter I

Title: Preliminary

(1) This Act may be called the Coconut Development Board Act, 1979. (2) It extends to the whole of India. (3) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint. Section 2 - Declaration as to expediency of control by the Union It is hereby declared that it is expedient in the public interest that the Union should take under its control the coconut industry. Section 3 - Definitions In this Act, unless the context otherwise requires,-- (a) "Board" means the Coconut Development Board established under section 4; (b) "Chairman" means the Chairman of the Board; (c) "coconut" means the fruit of coconut palm and includes green coconut, ripe coconut and copra. Explanation.-"Coconut Palm" means the coconut tree, Cocos Nucifera Linn; (d) "coconut industry" does not include-- (i) Coir industry; or (ii) an industry from which products (including by-products) out of coconut oil are manufactured; (e) "member" means a member of the Board and includes the Chairman; (f) "prescribed" means prescribed by rules made under this Act.

.....Service, and (3) the Indian Medical and Health Service. The present Bill seeks to create the aforesaid services by amending the All India Services Act, 1951. Under section 3of the Act, the Central Government would be empowered to make rules for the regulation of recruitment, and conditions of service of persons appointed, to these services. - S.O.R. -Gaz. of Ind., 19-11-1962, Pt. II, S. 2, Ext., p. 1012. Act 23 of 1975.- In service matters occasions arise when it becomes an inescapable necessity to amend or make rules with retrospective effect. An instance in point is the implementation of the decisions of the Government on the recommendations of the Third Central Pay Commission. 2.Section 3of the All India Services Act, 1951 which empowers the Central Government to make rules for the regulation of recruitment and the conditions of service of persons appointed to an All India Service does not in terms permit the making of the rules with retrospective effect. In view of the opinion tendered by the Attorney-General in 1969 in connection with a po,int raised by the Public Accounts Committee regarding an exemption notification issued with retrospective effect under the Central.....

.....Bill seeks to achieve the above objects. - Gaz.. of Ind., 25-7- 78. Pt. II, S. 2. Ext., p. 860. Act 21 of 1987- When the Coconut Development Board Act was enacted in 1979. horticultural and plantation crops were handled in the Crops Division headed by the Agriculture Commissioner in the Department of Agriculture and Co-operation and. accordingly, he was included as ex officio member of the Board. With the importance that the horticultural programmes have acquired and their contribution to the national economy, a separate full-fledged Division, known us Horticulture Division, headed by the Horticulture Commissioner, has been established. As the work of coconut development at the national level and that of the Coconut Development Board is being looked after by the Horticulture Commissioner, it is necessary that he may be made an ex officio member of the Board in place of the Agriculture Commissioner for taking effective participation in the activities of the Board by amending the Act. 2.
