.....Board shall be a body corporate by the name aforesaid having perpetual succession and a common seal with power, subject to the provisions of this Act, to contract and shall, by the said name, sue and be sued. (3) The Board shall consist of the following persons, namely:-- (a) Secretary to the Government of India in the Department of Science and Technology, ex officio--Chairperson; (b) Member-Secretary, Planning Commission, ex officio--Member; (c) Secretary to the Government of India in the Department of Biotechnology, ex officio--Member; (d) Secretary to the Government of India in the Department of Scientific and Industrial Research, ex officio--Member; (e) Secretary to the Government of India in the Ministry of Earth Sciences, ex officio--Member; (f) Secretary to the Government of India in the Department of Expenditure, Ministry of Finance or his nominee, ex officio--Member; (g) Secretary to the Government of India in the Department of Health Research, ex officio--Member; (h) not more than three members to be appointed by the Central Government from amongst persons having experience in scientific research in different disciplines in academic institutions; .....

.....Education and Research established under sub-section (1) or sub-section (2A) of section 4;'. 3. Amendment of section 4 In the principal Act, in section 4,-- (i) after sub-section (2), the following sub-section shall be inserted, namely:-- "(2A) The Central Government may, by notification in the Official Gazette, establish similar Institutes in different parts of the country."; (ii) in sub-section (5),-- (A) for clause (d), the following clause shall be substituted, namely:-- "(d) the Secretary, Technical Education, Government of the State within which the Institute is situated, ex officio;"; (B) after clause (j), the following clause shall be inserted, namely;--" (ja) a representative of the Pharmacy Council of India;". 4. Insertion of new section 4A In the principal Act, after section 4, the following section shall be inserted, namely:-- "Centres of Institute 4A. An Institute, with the prior approval of the Central Government, may, by notification in the Official Gazette, establish one or more centres in different locations within its jurisdiction.". 5. .....All-India Institute of Medical Sciences and the Post-Graduate Institute of Medical Education and Research (Amendment) Act, 2007. 2. Amendment of section 11 of Act 25 of 1956 In the All-India Institute of Medical Sciences Act, 1956, in section 11, after sub-section (1), the following sub-section shall be inserted, namely:-- "(1A) The Director shall hold office for a terra of five years from the dale on which he enters upon his office or until he attains the age of sixty-five years, whichever is earlier: Provided that any person holding office as a Director immediately before the commencement of the All-India Institute of Medical Sciences and the Post-Graduate Institute of Medical Education and Research (Amendment) Act, 2007, shall in so far as his appointment is inconsistent with the provisions of this sub-section, cease to hold office on such commencement as such Director and shall be entitled to claim compensation not exceeding three months' pay and allowances for the premature termination of his office or of any contract of service.". 3. Title: Relationship of Academy with Council of Scientific and Industrial Research

.....for mutual benefit (2) The Academy, within two weeks of the commencement of this Act, shall, notwithstanding anything contained in any other Act, rules, regulations or bye-laws for the time being in force, enter into a Memorandum of Understanding with the Council of Scientific and Industrial Research, for the purposes of its affiliation with the Academy for the purposes of academics, teaching and award of degrees or diplomas, and, the persons pursuing the studies in the Council for award of any degree or diploma, after entering of such Memorandum of Understanding, be awarded degrees or diplomas by the said Academy: Provided that any person pursuing any academic or research course, before the commencement of this Act, in the Council of Scientific and Industrial Research for award of any degree or diploma and registered for the said purpose with any other university, may, with the approval of the university with which such person is registered, migrate after such" commencement to the Academy established under this Act and be registered with the said Academy for grant of the same degree or diploma by the Academy established under this Act and such person shall be deemed to.....

Amendment of section 6 of Act 51 of 1966 In the Post-Graduate Institute of Medical Education and Research, Chandigarh Act, 1966, in section 6, in sub-section (2), after the words "as soon as he", the words "becomes a Minister or Minister of State or Deputy Minister, or the Speaker or the Deputy Speaker of the House of the People, or the Deputy Chairman of the Council of States, or" shall be inserted.

THE NATIONAL INSTITUTE OF PHARMACEUTICAL EDUCATION AND RESEARCH (AMENDMENT) ACT, 2002 [Act, No. 28 of 2002] [27th May, 2002] PREAMBLE An Act to amend the National Institute of Pharmaceutical Education and Research Act, 1998. BE it enacted by Parliament in the Fifty-third Year of the Republic of India as follows:-- 1. Short title This Act may be called the National Institute of Pharmaceutical Education and Research (Amendment) Act, 2002. 2. Amendment of section 4 of Act 13 of 1998 In section 4 of the National Institute of Pharmaceutical Education and Research Act, 1998, in sub-section (4), the following proviso shall be inserted, namely:-- "Provided that the term of office of a member nominated under clause (o) of sub-section (3) shall come to an end as soon as he becomes a Minister or Minister of State or Deputy Minister, or the Speaker or the Deputy Speaker of the House of the People, or the Deputy Chairman of the Council of States, or ceases to be a member of the House from which he was nominated.".
