If any person is, within the limits of {Substituted by Act 3 of 1951, section 3 and Sch., for "Part A States and Part C States."} [India], obtaining or attempting to obtain recruits for the service of any Foreign State in any capacity, the Central Government may, by order in writing {The words "signed by a Secretary to the G. of I." omitted by the A.O.1937}, either prohibit such person from so doing, or permit him to do so subject to any conditions which the Central Government thinks fit to impose.

.....shall, along with his application " a. If he /she is an Advocate or Pleader, produce from the Presiding Officer of the Court in which he/ she is actually practicing, a certificate indicating the length of his / her practice; b. If he / she is an Assistant Public Prosecutor, Grade I or an Assistant Public Prosecutor, Grade II, produce from the Collector of the District concerned, a certificate indicating the length of his / her service; c. Produce a certificate of good character, from a Senior Advocate /counsel and another from a responsible person, not being a relative but who is well acquainted with him / her in private life. The selection shall be made based on the results of written examination and viva voce i.e, the selection will be made on the basis of the total marks obtained by the candidates in the written examination and viva voce taken together subject to the rule of reservation of appointment. The maximum marks allotted for the written examination and viva voce shall be 75% and 25 % respectively. .....in respect of any art of which a garden-sardar holds a certificate may cancel the certificate if he is satisfied that the garden-sardar has contravened any of the provisions of this Act or of the rules made thereunder. (2) A District Magistrate cancelling a certificate under sub-section (1) shall record his reasons, and shall send intimation of his action to the District Magistrate of every other district in respect of any part of which the certificate was valid and to the person who granted the certificate. Section 31 - Penalty for illicit recruitment Whoever, not being a licensed recruiter holding a licence under section 27, or a garden-sardar holding a valid certificate under section 28, or a local forwarding agent holding a licence under section 17, in any part of a restricted recruiting area gives or offers any money or goods to any person, or defrays or offers to defray any travelling expenses of any person, as an inducement to such person to proceed to Assam as an assisted emigrant, shall be punishable with imprisonment which may extend to six months, or with fine which may extend to five hundred rupees, or with both.

Title: Permits for Recruitment by Employers

Section 19 - Registration of certain permits Any permit obtained from a person authorised under sub-section (2) of section 15 shall not be valid unless a certified copy thereof is filed in the prescribed manner with the Protector General of Emigrants. Section 20 - Cancellation or suspension of a permit The provisions of section 14 relating to cancellation and suspension of a certificate referred to therein shall, subject to such modifications as may be necessary (including modifications for construing the references in that section to registering authority as references to competent authority under this Chapter), apply for the cancellation or suspension of a permit. Section 21 - Power to exempt The Central Government may, if satisfied that it is necessary or expedient so to do in the public interest, by notification and subject to such conditions, if any, as may be specified in the notification, exempt any class or classes of employers from the requirement of obtaining a permit under this Chapter.
