Title: Liability of a Jagirdar or Cadet to Pay to Government Amounts Recovered or Received by Him from Permanent Holders Etc., in Certain Cases and Determination of Such Amount

.....in a Jagir village within his local jurisdiction, the Jagirdar or cadet has failed to pay to the State Government the amount payable by him under sub-section (1) [3][or subsection (1A),] he shall hold a summary inquiry in the manner provided in the Code and decide whether the Jagirdar or cadet has failed to pay the amount to the State Government, and if so, determine the amount to be recovered from the Jagirdar or cadet under sub-section (2). The amount so determined shall thereupon be recovered accordingly. (4) It shall be lawful for the Collector to deduct from the amount of compensation, which may be awarded to such Jagirdar or cadet under Sections 11, 12 or 14, the amount payable by him to the State Government under this Section. .....(1), the hire-purchase agreement, if not previously terminated, shall terminate, and-- (a) the hirer shall be released from all liability under the agreement and shall be entitled to recover from the owner all sums paid by the hirer under the agreement or under any security given by him in respect thereof; and (b) the surety shall be entitled to recover from the owner all sums paid by him under the contract of guarantee or under any security given by him in respect thereof. (3) Where, by virtue of the provisions of sub-section (1), the owner is precluded from enforcing a right to recover possession of the goods, he may make an application for recovery of possession of the goods to any court having jurisdiction to entertain a suit for the same relief, (4) The provisions of this section shall not apply in any case in which the hirer has terminated the agreement by virtue of any right vested in him.

Title: Farmer May Apply to Collector to Recover Amounts Due to Him

When any amount is due to 1 any farmer of the right of drawing toddy from any person who has drawn toddy from any toddy-producing tree, such farmer may apply to the Collector to recover such amount on his behalf and the Collector may in his discretion, recover such amount as if it were an arrear of land revenue, and shall pay any amount so recovered to the applicant: Provided that the execution of any process issued by the Collector for the recovery of such amount shall be stayed if the person from whom it is sought to recover the same institutes a suit in the Civil Court to try the demand of the farmer, and furnishes security to the satisfaction of the Collector for the payment of the amount which the Court may adjudge to be due from him to such farmer : Provided also that nothing contained in this section or done there under shall affect the right of any such farmer to recover by suit in the Civil Court or otherwise any amount due to him from any such person as aforesaid. ______________ 1. Title: Right to Recover Loans and Advances

(1) The right to recover any loans or advances made before the appointed day by the existing State of Punjab to any local body, society, agriculturist or other person in an area within that State shall belong to the successor State in whose territories that area is included: Provided that the right to recover loans or advances of pay and travelling allowance to a Government servant made before the appointed day by the existing State of Punjab shall pass to the successor State to which such Government servant is allotted. (2) The right to recover any loans or advances made before the appointed day by the existing State of Punjab to any person or institution outside that State shall belong to the State of Punjab : Provided that any sum recovered in respect of any such loan or advance shall be divided between all the successor States according to the population ratio.

Title: Right to Recover Immediate Possession of Premises to Accrue to Certain Persons

.....as the case may be, to indicate the dwelling house possession of which he intended to recover. Section 8 - Liability of person in possession, not as owner, to deliver to persons entitled to immediate possession Any person having the possession or control of a particular article of movable property, of which he is not the owner, may be compelled specifically to deliver it to the person entitled to its immediate possession, in any of the following cases.-- (a) when the thing claimed is held by the defendant as the agent or trustee of the plaintiff; (b) when compensation in money would not afford the plaintiff adequate relief for the loss of the thing claimed; (c) when it would be extremely difficult to ascertain the actual damage caused by its loss; (d) when the possession in the thing claimed has been wrongfully transferred from the plaintiff. Explanation.--Unless and until the contrary is proved, the court shall, in respect of any article of movable property claimed under clause (b) or clause (c) of this section, presume-- (a) that compensation in money would not afford the plaintiff adequate relief.....
