Kolkata Municipal Corporation Act, 1980 Complete Act

(7) "building of the warehouse class" means a building, the whole or a substantial part of which is used, or intended to be used, as a warehouse, factory, manufactory, brewery, or distillery, or for any similar purpose, which is neither a "domestic building" nor a "public building" as defined in this section, and includes a hut used or intended to be used for any of the purposes mentioned in this clause; (8) "bustee" means an area containing land not less than seven hundred square metres in area occupied by or for the purposes of any collection of huts or other structures used or intended to be used for human habitation. Explanation.-If any question arises as to whether any particular area is or is not a bustee, the Corporation shall decide the question and its decision shall be final; (9) "Kolkata" means the area described in Schedule I; 3 Clause (10) omitted by s. 2 of the Calcutta Municipal Corporation (Amendment) Act, 1996 (West Ben. ..... NOTES Good faith.-See section 2(7) of the Indian Limitation Act, 1908, section 52 of the Indian Penal Code and section 178 of the Indian Contract Act. An ex parte decree was passed on February 12, 1935 by Ahmednagar Court and it was transferred to Poona Court on February 25, 1935. The decree was set aside on January 15, 1936. Again an ex parte decree was passed in 1936. No darkhast for execution of the subsequent decree was filed till June, 16, 1947, but four darkhasts were filed successively in Poona Court to execute the earlier decree of 1935 and were disposed off in 1936, 1939, 1942 and 1946 respectively. A fifth darkhast was filed in 1946 to execute the earlier decree and an application made in 1947 to amend the darkhast so as to execute the subsequent decree. It was held, that the decree holder was not entitled to claim relief under section 14(2) of the Indian Limitation Act as the previous darkhasts were not prosecuted in good faith.-Sadashiv Shivramv. THE MADRAS GENERAL CLAUSES ACT, 1891 THE MADRAS GENERAL CLAUSES ACT, 1891 [Act No. 1 of 1891] PREAMBLE An Act for further shortening the language used in ( Substituted by the Government of India (Adaptation of Indian Laws) Order, 1937.) [Madras Acts] and for other purpose. Whereas it is expedient to further shorten the language used in [Madras Acts made] and to make certain further provisions relating to those Acts. It is hereby enacted as follows.- Section 1 - Short title (a) This Act may be called The Madras General Clauses Act, 1891; and (b) It shall come into force on the first day of January, 1892. Section 2 - Section 2 Notwithstanding anything contained in the Madras General Clauses Act. 1867, the provisions of that Act shall not apply to this Act or to any (Madras Act) which may be passed subsequent to the commencement of this Act. Section 3 - Definitions In this Act and in every (Madras Act made) after the commencement of this Act, unless there be something repugnant in the subject or context.- (1) "Abet".- "abet" with its grammatical variations and cognate expressions, shall have the same meaning as in the Indian Penal Code.
