Maharashtra Animal Preservation Act, 1976 Complete Act

.....under this Act shall be deemed to be public servants within the meaning of section 21 of the Indian Penal Code. SECTION 13: PROTECTION OF PERSONS ACTING IN GOOD FAITH TINDER ACT OR RULES No suit prosecution or other legal proceedings shall be instituted against any person for anything which is in good faith done or intended to be done under this Act or the rules made thereunder. SECTION 14: EXEMPTIONS UNDER THIS ACT Subject to any conditions prescribed in this behalf, this Act shall not apply to, - (a) any animal (other than cow) operated upon for vaccine, lymph or serum at any institution established, conducted or recognised by the State Government; (b) any animal (other than cow) operated upon for any experimental or research purposes at the institution referred to in clause (a); (c) any animal (other than cow) or class thereof ,- (i) slaughter of which is certified by a veterinary surgeon authorised in this behalf by the State Government to be necessary in the interest of the public health; (ii)Vol .2 F-12 which are suffering from any disease which is certified by such veterinary surgeon as being contagious and dangerous to other animals: Provided that no animal referred to.....

.....SHORT TITLE These rules may be called the Seeds Rules, 1968. ..... 16. Penalties. (1) If any person contravenes, or attempts to contravene, or abets the contraventions of, any of the provisions of this Act or rules he shall, on conviction, be punishable with imprisonment for a term which may extend to one month or with fine which may extend to two hundred rupees, or with fine. (2) Whoever, after conviction under sub-section (1), continues the contravention, he shall, on conviction, be punishable with fine which may extend to one hundred rupees for everyday, after the first day, during which such contravention continued. 17. Offence by companies. Prevention of Cruelty to Animals Act, 1960 Chapter VI

.....in certain cases If any person is charged with the offence of killing a goat, cow or its progeny contrary to the provisions of clause (1) of sub-section (1) of section 11, and it is proved that such person had in his possession, at the time the offence is alleged to have been committed, the skin of any such animal as is referred to in this section with any part of the skin of the head attached thereto, it shall be presumed until the contrary is proved that such animal was killed in a cruel manner. Prevention of Cruelty to Animals Act, 1960 Section 30

Title: Presumption as to Guilt in Certain Cases

If any person is charged with the offence of killing a goat, cow or its progeny contrary to the provisions of clause (1) of sub-section (1) of section 11, and it is proved that such person had in his possession, at the time the offence is alleged to have been committed, the skin of any such animal as is referred to in this section with any part of the skin of the head attached thereto, it shall be presumed until the contrary is proved that such animal was killed in a cruel manner.

Karnataka Live--stock Improvement Act, 1961 Section 5

Title: Refusal and Revocation of Licences

.....the person concerned of the grounds on which it is proposed to take action and he shall be given a reasonable opportunity of showing cause against it. (3) If a licence is revoked under this section, the State Government or the officer revoking the licence shall communicate the order of revocation along with the grounds of revocation, to the person keeping the bull or to the person stated in the licence to be the owner of the bull. (4) Against an order either refusing to grant or revoking a licence under sub--section (1) or sub--section (2) an appeal shall lie within thirty days of the communication of such order,-- (i) to the State Government, if the order is that of the Director, (ii) to the Director, if the order is that of any officer subordinate to the Director. Bombay Live-stock Improvement Act, 1933, (Maharashtra) Section 7

Title: Refusal to Grant or Revocation of Licence

(1) Subject to rules, the live-stock officer authorised to grant the licence may refuse to grant or may revoke a licence, if in the opinion of such authority, the bull appears to be - (a) of defective or inferior conformation and likely to be get defective or inferior progeny; or (b) permanently affected with any contagious or infectious disease; or (c) permanently affected with any other disease rendering the bull, unsuitable for breeding purposes. (2) The live-stock officer granting a licence may also revoke a licence if in the opinion of such officer there be any breach of any of the terms or conditions of the licence. (3) No person shall be entitled to any compensation for the revocation of a licence under sub-section (1) or (2). (4) If a licence is revoked under sub-section (1) or (2), the live-stock officer revoking the licence shall give notice to that effect to the owner or the person stated therein to be the owner of the bull and any such notice given in respect of a licence shall state the grounds for the revocation. 1[(5) * * *] _________________ 1. The Prevention of Cruelty to Animals Act, 1960 Complete Act

(2) No order under sub-section (1) shall be made unless it is shown by evidence as to a previous conviction under this Act or as to the character of the owner or otherwise as to the treatment of the animal that the animal, if left with the owner, is likely to be exposed to further cruelty.
