.....that if any constituency does not again elect a member, then proceedings of fresh election in such constituency shall be started only after satisfaction of the State Election commission to the effect that there is the possibility of a member being elected from the said constituency. Section 34 - Incorporation of the Panchayat Samiti Every Panchayat Samiti shall be a body corporate in the name of its Panchayat Samiti having perpetual succession and a common seal, and the shall, subject to such restrictions as may be imposed by or under this Act or any other Act, have vested in it the powers to sue or be sued or to acquire, hold and transfer movable or immovable property within or beyond the limits of its jurisdiction or to enter into agreements and to do everything necessary, proper and expedient for the purposes for which it has been constituted in its own corporate name.
