Title: Continuance of Privy Council Jurisdiction in Certain Pending Cases

Nothing contained in shall affect the jurisdiction of His Majesty in Council to dispose of- (a) any Indian appeal or petition on which the Judicial Committee of the Privy Council has before the appointed day delivered judgment or, as the case may be, reported to His Majesty, but which has not been determined by an Order in Council of His Majesty; or (b) any Indian appeal or petition on which the Judicial Committee has after hearing the parties, reserved judgment or order; or (c) any Indian appeal which has been entered before the appointed day in the list of business of the Judicial Committee for the Michaelmas sittings of the year 1949 and which after that day is not directed to be removed there from, by or under the authority of the Judicial Committee; or (d) any Indian petition which has been lodged before the appointed day in the Registry of the Privy Council.

ABOLITION OF PRIVY COUNCIL JURISDICTION ACT, 1949 [Act, No. 5 of 1949] PREAMBLE An Act to abolish the jurisdiction of His Majesty in Council in respect of Indian appeals and petitions. WHEREAS it is expedient to abolish the jurisdiction of His Majesty in Council in respect of Indian appeals and petitions, and to confer a corresponding jurisdiction on the Federal Court of India. It is hereby enacted as follows:

.....of this Act stand transferred to the Federal Court, and shall be disposed of by it in the exercise of the jurisdiction conferred on it by this Act. SECTION 07: CONTINUANCES OF CERTAIN PROCEEDINGS IN HIGH COURT All proceedings and steps taken in, and orders made and certificates granted by, a High Court in connection with an Indian appeal or petition shall, except in the case of any such appeal or petition as is referred to in (section 4) be deemed to be in connection with an appeal or petition to the Federal Court from, or in respect of, the same judgment, decree or order under the provisions of this Act, and shall be concluded, or as the case may be, have effect accordingly. SECTION 08: EFFECTS OF ORDERS OF HIS MAJESTY IN COUNCIL Any order of His Majesty in Council made on an Indian appeal or petition, whether before, on or after the appointed day, shall for all purposes have effect, not only as an order of His Majesty in Council, but also as if it were an order or decree made by the Federal Court in the exercise of the jurisdiction conferred by this Act. Title: Provision of Privies, Etc.

.....such building or land to provide such privies, cesspools or water closets as the Grama Panchayat may deem proper. (2) A Grama Panchayat may, by written notice, require any person or persons employing workmen or labourers exceeding twenty in number or owning or managing any market, school or theatre or other place of public resort, to provide such latrines and urinal as the Grama Panchayat may direct, and to cause the same to be kept in proper order, and to be daily cleansed. (3) A Grama Panchayat may, by written notice, require the owner or occupier of any land upon which there is a privy or urinal to have such privy or urinal shut out, by a sufficient roof and a wall or fence, from the view of the persons passing by or resident in the neighbourhood or to alter as it may direct any privy door or trap-door which opens on to any street, and which it deems to be a nuisance.

Karnataka Municipal Corporations Act, 1976 Section 247

Title: Provision of Privies by Owner or Occupier

State: Karnataka

Year: 1976

(1) The Commissioner may, by notice require, the owner or occupier of any building, within such time and in accordance with such direction as may be specified therein, to provide flush-out or other privies for the use of the persons employed in or about or occupying such building or alter or remove from an unsuitable place to a more suitable place any existing privy. Such owner or occupier shall keep every such privy clean and in proper order. (2) Every owner or occupier of the ground on which any block of huts stands shall, within such time and in accordance with such directions as may be specified in a notice issued by the Commissioner, provide flush-out or other privies for the use of the inhabitants of such block of huts or alter or remove from an unsuitable place to a more suitable place any existing privy and shall keep the same clean and in proper order.

Recognition granted to Rulers of Indian States to cease and privy purses to be abolished Notwithstanding anything in this Constitution or in any law for the time being, in force-- (a) the Prince, Chief or other person who, at any time before the commencement of me Constitution (Twenty-sixth Amendment) Act, 1971, was recognised by the President as the Ruler of an Indian State or any person who, at any time before such commencement, was recognised by the President as the successor of such Ruler shall, on and from such commencement, cease to be recognised as such Ruler or the successor of such Ruler; (b) on and from the commencement of the Constitution (Twenty-sixth Amendment) Act, 1971, privy purse is abolished and all rights, liabilities and obligations in respect of privy purse are extinguished and accordingly the Ruler or, as the case may be, the successor of such Ruler, referred to in clause (a) or any other person shall not be paid any sum as privy purse.] ________________________ 1. Karnataka Municipal Corporations Act, 1976 Section 246

(1) The Commissioner may license for any period not exceeding one year the provision and maintenance of privies for public use. (2) No person shall keep a public privy without a licence under subsection (1). (3) Every licensee of a public privy shall maintain it in clean and proper order.

Karnataka Panchayat Raj Act, 1993 Section 105

Title: Cost of Altering, Repairing and Keeping in Proper Order Privies Etc.

(1) All sewers, drains , privies, water closets, house-gullies and cesspools within a panchayat area shall, unless constructed at the cost of the Grama Panchayat be altered, repaired, and kept in proper order at the cost and charges of the owner of the land and buildings to which the same belong, or for the use of which they are constructed or continued, and the Grama Panchayat may, by written notice, require such owner to alter, repair and put the same in good order in such manner as it thinks fit. (2) The Grama Panchayat may, by written notice, require the owner to demolish or close any privy or cesspool whether constructed before or after the coming into force of this Act, which in the opinion of the Grama Panchayat, is a nuisance, or is so constructed as to be inaccessible for the purposes of scavenging or incapable of being properly cleansed or kept in good order.
