THE CHILD MARRIAGE RESTRAINT ACT, I929 THE CHILD MARRIAGE RESTRAINT ACT, I929 [Act No. 19 of 1929 dated 1st. October, 1929] 1 An Act to restrain the solemnisation of child marriages. WHEREAS it is expedient to restrain the solemnisation of child marriages; it is hereby enacted as follows: - SECTION 01: SHORT TITLE, EXTENT AND COMMENCEMENT (1) This Act may be called the Child Marriage Restraint Act, 2[1929]. 3[ (2) It extends to the whole of India 4[except the State of Jammu and Kashmir]; and it applies also to all citizens of India without and beyond India].5 (3) It shall come into force on the 1st day of April, 1930. SECTION 02: DEFINITIONS In this Act, unless there is anything repugnant in the subject or context,- 6[(a) "child" means a person who, if a male, has not completed twenty-one years of age, and if a female, has not completed eighteen years of age;] (b) "child marriage" means a marriage to which either of the contracting parties is a child; (c) "Contracting party" to a marriage means either of the parties whose marriage is 7[or is about to be] thereby solemnised; and (d) "minor" means a person of either sex who is under eighteen years of age. .....

Title: Theft After Preparation Made for Causing Death, Hurt or Restraint in Order to the Committing of the Theft

Whoever commits theft, having made preparation for causing death, or hurt, or restraint, or fear of death, or of hurt, or of restraint, to any person, in order to the committing of such theft, or in order to the effecting of his escape after the committing of such theft, or in order to the retaining of property taken by such theft, shall be punished with rigorous imprisonment for a term which may extend to ten years, and shall also be liable to fine. Illustrations (a) A commits theft on property in Z's possession; and, while committing this theft, he.has a loaded pistol under his garment, having provided this pistol for the purpose of hurting Z in case Z should resist. A has committed the offence defined in this section. (b) A picks Z's pocket, having posted several of his companions near him, in order that they may restrain Z, if Z should perceive what is passing and should resist, or should attempt to apprehend A. A has committed the offence defined in this section.

No complainant or witness on his way to any Court shall be required to accompany a police officer, or shall be subject to unnecessary restraint or inconvenience, or required to give any security for his appearance other than his own bond: Provided that, if any complainant or witness refuses to altend or to execute a bond as directed in section 170, the officer in charge of the police station may forward him in custody to the Magistrate, who may detain him in custody until he executes such bond, or until the hearing of the case is completed.
