Title: Marking of Heavy Packages (Amendment) Act, 1961

.....of India as follows:-- 1. Short title.-- This Act may be called the Marking of Heavy Packages (Amendment) Act, 1961. 2. Substitution of new sections for sections 4 and 5.-- For sections 4 and 5 of the Marking of Heavy Packages Act, 1951, (39 of 1951) the following sections shall be substituted, namely:-- "4.Inspectors.-- (1) The Central Government may, by notification in the Official Gazette, appoint such persons as it thinks fit to be inspectors for the purposes of this Act and assign to each of them one or more areas to be specified in the notification, or to two or more of them the same area to be so specified. (2) Every inspector shall be deemed to be a public servant within the meaning of section 21 of the Indian Penal Code(45 of 1860). 5. Powers of inspectors.-- Subject to any rules made by the Central Government in this behalf, an inspector appointed under sub-section (1) of section 4 may-- (a) enter, with such assistants as he considers necessary, and inspect any place or vessel and examine any packages found therein; (b) if, on such examination, any heavy package is found not to have been marked in accordance with the provisions of section 3,.....

..... [Act, No. 14 of 2003] [17th January, 2003] An Act further to amend the Pre-natal Diagnostic Techniques (Regulation and Prevention of Misuse) Act, 1994. BE it enacted by Parliament in the Fifty-third Year of the Republic of India as follows:-- 1. Short title and commencement (1) This Act may be called the Pre-natal Diagnostic Techniques (Regulation and Preventin of Misuse) Amendment Act, 2002. (2) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint. 2. Substitution of long title In the Pre-natal Diagnostic Techniques (Regulation and Prevention of Misuse) Act, 1994 (57 of 1994) (hereinafter referred to as the principal Act), for the long title, the following long title shall be substituted, namely:-- "An Act to provide for the prohibition of sex selection, before or after conception, and for regulation of pre-natal diagnostic techniques for the purposes of detecting genetic abnormalities or metabolic disorders or chromosomal abnormalities or certain congenital malformations or sex-linked disorders and for the prevention of their misuse for sex determination leading to female foeticide and for.....

Title: Regulation of Pre-natal Diagnostic Techniques

.....in the clinic in such manner, as may be prescribed, andany deficiency or inaccuracy found therein shall amount to contraventionof the provisions of section 5 or section 6 unlesscontrary is proved by the person conducting such ultrasonography; (4) noperson including a relative or husband of the pregnant woman shall seekor encourage the conduct of any pre-natal diagnostic techniques on her exceptfor the purposes specified in clause (2); (5) noperson including a relative or husband of a woman shall seek or encourage theconduct of any sex-selection technique on her or him or both.] ____________________ 1.Substituted by Act 14 of 2003,sec. 7, for clauses (3) and (4) (see Annexe). Section 5 - Written consent of pregnant woman and prohibition of communicating the sex of foetus ( 1) No person referred to in clause ( 2) of section 3 shall conduct the pre-natal diagnostic procedures unless-- (a) he has explained all known side and after effects of such procedures to the pregnant woman concerned; (b) he has obtained in the prescribed form her written consent to undergo such procedures in the language which she understands; and (c) a copy of her written consent obtained.....

Title: Prohibition of Advertisement Relating to Pre-conception and Pre-natal Determination of Sex and Punishment for Contravention

( 3) Any person who contravenes the provisions of sub-section ( 1) or sub-section ( 2) shall be punishable with imprisonment for a term which may extend to three years and with fine which may extend to ten thousand rupees. Explanation.--For the purposes of this section, "advertisement" includes any notice, circular, label, wrapper or any other document including advertisement through internet or any other media in electronic or print form and also includes any visible representation made by means of any hoarding, wall-painting, signal, light, sound, smoke or gas.'. _______________________ 1 .
