.....1981-82 Be it enacted by Parliament in the Thirty-second Year of the Republic of India as follows SECTION 01: SHORT TITLE AND COMMENCEMENT (1) This Act may be called The finance Act, 1981. (2) Save as otherwise provided in this Act,sections 2-to45-andsection 53-shall be deemed to have come into force on the 1st day of April, 1981. SECTION 02: INCOME-TAX (1) Subject to the provisions of sub-section (2) and (3), for the assessment year commencing on the 1st day of April, 1981, income-tax shall be charted at the rates specified in part I of the First Schedule and shall be increased, - (a) in the cases to which Paragraphs A, B, C and D of that Part apply, by a surcharge for purposes of the Union; and (b) in the cases to which Paragraph E of that part applies, by a surcharge, calculated in each case in the manner provided therein. Title: Offences by Government Department

(1) Where an offence under this Act has been committed by any Department of Government, the Head of the Department shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished accordingly: Provided that nothing contained in this section render such Head of the Department liable to any punishment if he proves that the offence was committed without his knowledge or that he exercised all due diligence to prevent the commission of such offence. (2) Notwithstanding anything contained in sub-section (1), where an offence under this Act has been committed by a Department of Government and it is proved that the offence has been committed with the consent or connivance of, or is attributable to any neglect on the part of, any officer, other than the Head of the Department, such officer shall also be deemed to be guilty of that offence and shall be liable to be proceeded against and punished accordingly.
