Explanation 1.--For the purpose of this section, "private act" includes an act of watching carried out in a place which, in the circumstances, would reasonably be expected to provide privacy and where the victim's genitals, posterior or breasts are exposed or covered only in underwear; or the victim is using a lavatory; or the victim is doing a sexual act that is not of a kind ordinarily done in public. .....(1) of Section 4-or any other offence specified in Article 1-of the Convention, shall not be considered to be an offence of a political character. SECTION 06: OFFENCES COMMITTED OUTSIDE INDIA (1) When an offence under sub- section (1) of Section 4-or any other offence specified in Article 1-of the Convention is committed outside India,- (a) by a citizen of India, whether on the high seas or elsewhere; (b) by a person, not being such citizen, on any ship or aircraft, registered in India; or (c) by a person, not being such citizen, in a Convention country, he may be dealt with in respect of such offence as if it had been committed at any place within India at which he may be found.
