Maharashtra Fruit Nurseries and Sale of Fruit Plants (Regulation) Act, 1969 Complete Act

.....SECTION 16: COGNIZANCE OF OFFENCE No court shall take cognizance of any offence punishable under this Act except on the report in writing of the facts constituting such offence made by the Competent Authority or any officer authorised by the State Government in this behalf. SECTION 17: JURISDICTION OF COURT No court inferior to that of a Presidency Magistrate, or a Magistrate of the first class, shall try any offence punishable under this Act. SECTION 18: OFFICERS AND PERSONS EXERCISING POWERS UNDER THIS ACT TO BE PUBLIC SERVANTS All officers appointed under this Act and every person authorised to exercise any powers conferred or to perform any duties imposed on him by or under this Act shall be deemed to be public servants within the meaning of section 21 of the Indian Penal Code. SECTION 19: PROTECTION OF ACTION TAKEN IN GOOD FAITH No suit, prosecution or other legal proceeding shall lie against the State Government or any officer or person for anything which is in good faith done or intended to be done in pursuance of this Act or any rules made thereunder. SECTION 20: POWER TO DELEGATE The State Government may, by notification in the Official Gazette, direct that any power.....

Title: Of the Relevancy of Facts

Evidence may be given in any suit or proceeding of the existence or non-existence of every fact in issue and of such other facts as are hereinafter declared to be relevant, and of no others. Explanation.-This section shall not enable any person to give evidence of a fact which he is disentitled to prove by any provision of the law for the time being in force relating to civil procedure1 . Illustrations (a) A is tried for the murder of B by beating him with a club with the intention of causing his death. At A's trial the following facts are in issue:- A's beating B with the club; A's causing B's death by such beating; A's intention to cause B's death. (b) A suitor does not bring with him, and have in readiness for production at the first hearing of the case, a bond on which he relies. This section does not enable him to produce the bond or prove its contents at a subsequent stage of the proceedings, otherwise than in accordance with the conditions prescribed by the Code of Civil Procedure. _______________________ 1. Title: Cases in Which Statement of Relevant Fact by Person Who is Dead or Cannot Be Found, Etc., is Relevant

.....procured, without an amount of delay or expense which under the circumstances of the case appears to the Court unreasonable, are themselves relevant facts in the following cases:-- (1) when it relates to cause of death.-When the statement is made by a person as to the cause of his death, or as to any of the circumstances of the transaction which resulted in his death, in cases in which the cause of that person's death comes into question. Such statements are relevant whether the person who made them was or was not, at the time when they were made, under expectation of death, and whatever may be the nature of the proceeding in which the cause of his death comes into question. (1) If any person contravenes, or attempts to contravene, or abets the contraventions of, any of the provisions of this Act or rules he shall, on conviction, be punishable with imprisonment for a term which may extend to one month or with fine which may extend to two hundred rupees, or with fine. (2) Whoever, after conviction under sub-section (1), continues the contravention, he shall, on conviction, be punishable with fine which may extend to one hundred rupees for everyday, after the first day, during which such contravention continued. 17. Offence by companies. (1) Where an offence under this Act has been committed by a company, every person who, at the time the offence was committed, was in charge of and was responsible to, the company for the conduct of the business of the company, as well as the company, shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished accordingly:- Provided that nothing contained in this section shall tender any such person liable to any punishment provided in this Act if he proves that the offence was committed without his knowledge or that he had exercised all cue.....
