In this Act, unless the context otherwise requires,-- (a) "Scheduled Castes Order" means the Constitution (Scheduled Castes) Order, 1950, made by the President under article 341 of the Constitution; (b) "Scheduled Tribes Orders" means the Constitution (Scheduled Tribes) Order 1950, the Constitution (Uttar Pradesh) Scheduled Tribes Order, 1967 and the Constitution (Sikkim) Scheduled Tribes Order, 1978, made by the President under article 342 of the Constitution. (1) This Act may be called the Patents (Amendment) Act, 2005. In section 16 of the principal Act,- (a) in sub-section (1), for the words "before the acceptance of the complete specification", the words "before the grant of the patent" shall be substituted; (b) for the Explanation, the following Explanation shall be substituted, namely:- "Explanation.- For the purposes of this Act, the further application and the complete specification accompanying it shall be deemed to have been filed on the date on which the first mentioned application had been filed, and the further application shall be proceeded with as a substantive application and be examined when the request for examination is filed within the prescribed period.".
