(1) The Representation of the People (Amendment) Ordinance, 2002 (ORD. 4 OF 2002) is hereby repealed. For section 117G of the principal Act [as inserted by the Patents (Amendment) Act, 2002(38 of 2002)], the following section shall be substituted, namely:- "117G. Transfer of pending proceedings to Appellate Board.-- All cases of appeals against any order or decision of the Controller and all cases pertaining to revocation of patent other than on a counter-claim in a suit for infringement and rectification of register pending before any High Court, shall be transferred to the Appellate Board from such date as may be notified by the Central Government in the Official Gazette and the Appellate Board may proceed with the matter either de novo or from the stage it was so transferred.". In section 138 of the principal Act, for sub-section (1), the following subsection shall be substituted, namely:- "(1) Where a convention application is made in accordance with the provisions of this Chapter, the applicant shall furnish, when required by the Controller, in addition to the complete specification, copies of the specifications or corresponding documents filed or deposited by the applicant in the patent office of the convention country as referred to in section 133 verified to the satisfaction of the Controller, within the prescribed period from the date of communication by the Controller.".
