Emigration Act, 1983 Section 31

Title: Power to Prohibit Emigration Due to Outbreak of Epidemics, Civil Disturbances, Etc., in a Country

(1) Where the Central Government has reason to believe-- (a) that intending emigrants if allowed to emigrate to any country would be exposed to serious risk to life on arrival there by reason of-- (i) outbreak of any disease or grave pollution of environment in such country, or (ii) outbreak of hostilities or civil war or civil commotion or political disturbances; (b) that by reason of India not being in diplomatic relations with that country it is not possible to protect the emigrants from discrimination, maltreatment and exploitation, it may, by notification, prohibit emigration to that country. (2) A notification issued under sub-section (1) shall have effect for such period not exceeding six months as may be specified in the notification: Provided that if the Central Government has reason to believe that any ground mentioned in sub-section (1) continues to exist, it may, from time to time, by notification, prohibit emigration to that country for such further period, not exceeding six months on each occasion, as may be specified in the notification.

Title: Special Measures in Case of Outbreak of Infectious or Epidemic Diseases

.....any class or section of the public, as he thinks necessary to prevent the outbreak or the spread of the disease: Provided that, where in the opinion of the1[Officer Commanding-in-Chief, the Command], immediate measures are necessary, he may take action without such sanction as aforesaid and, if he does so, shall forthwith report such action to the2[Central Government]. (2) Whoever commits a breach of any temporary regulation made under sub-section (1) shall be deemed to have committed an offence under section 188 of the Indian Penal Code (45 of 1860.). ________________________ 1. Cantonments Act, 2006 Section 157

Title: Special Measures in Case of Outbreak of Infectious or Epidemic Diseases

(1) In the event of a cantonment being visited or threatened by an outbreak of any infectious or contagious disease among the inhabitants thereof or of any epidemic disease among any animals therein, the Officer Commanding the Station, if he thinks that the provisions of this Act or of any law for the time being in force in the cantonment are insufficient for the purpose, may, with the previous sanction of the Central Government-- (a) take such special measures, and (b) by public notice, make such temporary regulations to be observed by the public or by any class or section of the public, as he thinks necessary to prevent the outbreak or the spread of the disease: Provided that where in the opinion of the Officer Commanding the Station, immediate measures are necessary, he may take action without such sanction as aforesaid and, if he does so, shall forthwith report such action to the Central Government. (2) Whoever commits a breach of any temporary regulation made under sub-section (1) shall be deemed to have committed an offence under section 188 of the Indian Penal Code.

Karnataka Police Act, 1963 Section 42

Title: Special Measures to Prevent Outbreak of Epidemic Disease at Fair, Etc

.....officer of the Department of Public Health, prescribe such regulations to be observed by the residents of the said place and by persons present thereat or repairing thereto or returning therefrom, as he shall deem necessary to prevent the outbreak of such disease or the spread thereof. (2) It shall be lawful for the District Magistrate on the requisition of the Commissioner or Superintendent to assess and levy such reasonable fees on persons falling under the provisions of sub-section (1) as will provide for the expenses of the arrangements for sanitation and the preservation of order at and about the place of assemblage. (3) When the place of assemblage is within the limits of an area under the jurisdiction of a municipal body such sums as shall be necessary for the purpose aforesaid may be recovered from the municipal body.

Title: Duties of Municipal Council on Threatened or Actual Outbreak of Infectious Disease

.....by the municipal council no claim for compensation shall lie for any loss or damage caused by any exercise of the powers specified therein. (5) If in any 1 [municipal area] in which such declaration under sub-section (2), as aforesaid is for the time being in force, any person, -- (a) knowingly disobeys any order which for the time being is in force in such 1 [municipal area] and which has been passed by the municipal council in exercise of any power conferred on it by section 248 or under this section, or (b) obstructs any officer of the municipal council or other person acting under the authority of the municipal council in carrying out or executing any such order, such person shall be punishable with fine which may extend to one thousand rupees. _______________________________ 1. Title: District Magistrate May Take Special Measures to Prevent Outbreak of Epidemic Disease at Fair, Etc.

.....such regulations to be observed by the residents of the said place and by persons present thereat or returning thereto or returning therefrom as he shall deem necessary to prevent the outbreak of such disease or the spread thereof. (2) It shall be lawful for the District Magistrate or for the Collector or the Chief Presidency Magistrate on the requisition of the Commissioner or the District Magistrate to assess and levy such reasonable fees on persons falling under the provisions of sub-section (1) as will provide for the expenses of the arrangements for sanitation and the preservation of order at and about the place of assemblage. (3) When the place of assemblage is within the limits of a municipality or corporation such sums as shall be necessary for the purposes aforesaid may be recovered from the municipality or corporation.

Cantonments Act, 2006 Chapter VIII

Title: Sanitation and the Prevention and Treatment of Disease Sanitary Authorities

.....or with the consent of the occupier of any building or land, or, where the occupier of any building or land fails to make arrangements to the satisfaction of the Chief Executive Officer for the matters referred to in this section, without such consent, and after giving notice in writing to the occupier, the Chief Executive Officer may undertake the house scavenging of any building or land in the cantonment for such period as he thinks fit on such terms as he may specify in this behalf.
