DELHI ORPHANAGES AND WOMEN'S HOMES (SUPERVISION AND CONTROL) ACT, 1956 Complete Act

.....home" means an institution, by whatever name it may be called, where widows or women of any age are kept or are intended to be kept for care. Section3 Act not to apply to certain institution Nothing in this Act shall apply to any institution established, maintained or certified by Government under any law for the time being in force. Section4 Prohibition to open or maintain a orphanage or women's home without a licence No person shall, without or otherwise than in conformity with the conditions of, a licence granted under Section 5, open or maintain an orphanage or a women's home. Provided that a person maintaining any orphanage or women's home at the commencement of this Act shall be allowed a period of six months from such commencement to obtain such a licence. Section5 Licence to open or to maintain an orphanage or women's home (1) Subject to the provisions of this Act and the rules made thereunder, the District Magistrate may, on receipt of an application from any person in the prescribed form containing the prescribed particulars, grant to such person a licence in the prescribed form for opening and maintaining or, as the case may be, for.....

Section 4 Prohibition to open or to carry on an orphanage, a widows' home or a marriage bureau without a licence No person shall without, or otherwise than in conformity with the conditions of, a licence granted under this Act in the prescribed form open or carry on an orphanage, a widows' home or a marriage bureau : Provided that a person carrying on any such institution at the commencement of this Act shall be allowed a period of six months.....

.....which it has approved; and thereupon the regulation shall have effect accordingly, but without prejudice to the exercise of the powers of the Board under sub-section (1). SECTION 31: REPEAL AND SAVINGS (1) As from the date of the coming into force in any State3of this Act, the Women's and Children's Institutions (Licensing) Act, 1956,' or any other Act corresponding to this Act in force in that State immediately before such commencement, shall stand repealed. (2) Notwithstanding such repeal, anything done or any action taken (including any direction given, any register or rule or order made or any restriction imposed) under the said Act shall, insofar as such thing or action is not inconsistent with the provisions of this Act, be deemed to have been done or taken under the provisions aforesaid, as if they were in force when such thing was done or such action was taken, and shall continue in force accordingly until superseded by anything done or any action taken under this Act. Repeal and savings (1) As from the date of the cominginto force in any State1 of this Act, the Women's and Children'sInstitutions (Licensing) Act, 1956,1 or any other Act correspondingto this Act in force in that State immediately before such commencement, shallstand repealed. (2) Notwithstanding such repeal,anything done or any action taken (including any direction given, any registeror rule or order made or any restriction imposed) under the said Act shall,insofar as such thing or action is not inconsistent with the provisions of thisAct, be deemed to have been done or taken under the provisions aforesaid, as ifthey were in force when such thing was done or such action was taken, and shallcontinue in force accordingly until superseded by anything done or any actiontaken under this Act. ______________________ 1.This Act has been enforced in Kerala and Rajasthan so far. Naturally,Act 105 of 1956 stands repealed in those two States.

Title: Preliminary

.....under section 20; (f) "managing committee" means the committee of management referred to in section 20; (g) "recognised home" means a home in respect of which a certificate has been granted; (h)"prescribed" means prescribed by rules made under thisAct; (i) "woman" means a female who has completed the age of eighteen years. Section 3 - Act not to apply to certain institutions Nothing in this Act shall apply to-- (a) any hostel or boarding house attached to, or controlled or recognised by an educational institution; or (b) any protective home established under the Suppression of Immoral Traffic in Women and Girls Act, 1956; or (c) any reformatory, certified or other school, or any home or workhouse, governed by any enactment for the time being in force. Section 4 - Effect of Act on instruments governing recognised homes The provisions of this Act shall have effect notwithstanding anything inconsistent therewith contained in any instrument governing a recognised home.

In thisAct, unless the context otherwise requires,-- (a) "Board" means the Board of Control established under section 5; (b) "Certificate" means the certificate of recognition granted under section 15; (c) "child" means a boy or girl who has not completed the age of eighteen years; (d) "home" means an institution, whether called an orphanage, a home for neglected women or children, a widows' home, or by any other name, maintained or intended to be maintained for the reception, care, protection and welfare of women or children; (e) "manager" means a member of the managing committee appointed as such by the committee under section 20; (f) "managing committee" means the committee of management referred to in section 20; (g) "recognised home" means a home in respect of which a certificate has been granted; (h)"prescribed" means prescribed by rules made under thisAct; (i) "woman" means a female who has completed the age of eighteen years.

.....any method of encouraging any person to purchase or use infant milk substitute, feeding bottle or infant food.'. (2) Any reference in this Act to any other enactment or any provision thereof, shall, in relation to an area in which such enactment or such provision is not in force, be construed as a reference to the corresponding law or the relevant provision of the corresponding law, if any, in force in that area. SECTION 04: PROHIBITION OF INCENTIVES FOR THE USE OR SALE OF INFANT MILK SUBSTITUTES OR FEEDING BOTTLES OR INFANT FOODS No person shall- (a) supply or distribute samples of infant milk substitutes or11feeding bottles or.....
