I OF 19722 1st February 1972 An Act to provide for the recognition of trade unions for facilitating collective bargaining for certain undertakings, to state their rights, and obligations; to confer certain powers on unrecognised unions; to provide for declaring certain strikes and lock-outs as illegal strikes and lock-outs; lo define and provide for the prevention of certain unfair labour practices; to constitute courts (as independent machinery) for carrying out the purposes of according recognition to trade unions and for enforcing the provisions relating to unfair practices; and to provide for matters connected with the purposes aforesaid. .....Court in respect of the powers conferred under Section 33 of the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971, (Maharashtra Act No. 1 of 1972) CHAPTER I-GENERAL 1. The regulations may be cited as "The Industrial Court Regulations 1975". 2. (1) In these Regulations unless repugnant to the subject or the context- (a) "Advocate" means a person who is qualified to be enrolled as an Advocate under the Advocates' Act and enrolled as such. (b) "Application" means any application in writing under any of the provisions of the Act, Rules or these Regulations. (c) "Commissioner" means a person appointed by the Court for examination of witnesses. (d) "Deponent" with reference to an affidavit means the person who signs the affidavit and also swears to the truth of the statement in the affidavit. (e) "Member" means a member of the Industrial Court appointed by the State Government under the Act. .....[----] (15) "surplus area" means the area in excess of the permissible area; (16) "tenant" has the meaning assigned to it in the Punjab Tenancy Act, 1887 (Act XVI of 1887) and includes a sub-tenant and self-cultivating lessee, but shall not include a present holder as defined in clause (f) of section 2 of the East Punjab Displaced Persons (Land Resettlement) Act, 1949; (17) all other words and expressions used herein and not defined but defined in the Punjab Tenancy Act, 1887 (Punjab Act XVI of 1887), or the Punjab Land Revenue Act, 1887 (Punjab Act XVII of 1887) shall have the meaning assigned to them in either of those Acts.
