Wakf Act, 1995 Section 105

Title: Power of Board and Chief Executive Officer to Require Copies of Documents, Etc. to Be Furnished

Notwithstanding anything contained in any law for the time being in force, it shall be lawful for the Board or the Chief Executive Officer to require any person having the custody of any record, register, report or other document relating to a wakf or any immovable property, which is wakf property, to furnish subject to the payment of necessary costs, copies of, or extracts from, any such record, register, report or document and every person to whom such a requisition is made, shall furnish, as soon as may be practicable, to the Board or Chief Executive Officer copies or extracts from the required record, register, report or other document.

Title: Office Copy of Declaration to Be Prima Facie Evidence

In any legal proceeding whatever, as well civil as criminal, the production of a copy of such declaration as is aforesaid, attested by the seal of some Court empowered by this Act to have the custody of such declarations, { Ins.by Act 14 of 1922, s.3 and Sch.I.} [or printed on such newspaper, as the ca se may be] that the said person was printer or publisher, or printer and publisher (according as the words of the said declaration may be) of every portion of every { Subs.by s.3 and Sch.I, ibid., for "periodical work"} [newspaper] whereof the title shall correspond with the title of the { Subs.by s.3 and Sch.I, ibid., for "periodical work"} [newspaper] mentioned in the declaration { Ins.by Act 14 of 1922, s.3 and Sch.I.} [or the editor of every portion of that issue of the newspaper of which a copy is produced].

Every petition of appeal shall be accompanied by a copy of the order or decision appealed against: and it shall be competent for the officer before whom the appeal is presented to reject the appeal if on perusal of the petition it appears to him that there is no sufficient ground for questioning the correctness of the decision, or for interfering with the order appealed against. Provided that the spouse of such Speaker shall not be entitled to receive pension available to the spouse of any member of Parliament who dies during his term of office as such member for a period of five years from the date of death of the member under sub-section (1A) of section 8A of the Salary, Allowances and Pension of Members of Parliament Act, 1954 (30 of 1954). (2) Without prejudice to the provisions of clause (a) of sub-section (2) of section 4 and subject to any rules made in this behalf under section 11, such spouse shall be entitled to the use of unfurnished residence 'without payment of licence fee for the remainder of her life. (3) Subject to any rules made in this behalf under section 11,-- (a) such spouse, for the remainder of her life; and (b) the minor children of such Speaker, shall be entitled to medical attendance and treatment, free of charge,".

Explanation 2.--In this sub-section, the expression "foreigner" means a person who is not a citizen of India..] (2) Notwithstanding any judgment, decree or order of any court, every former Secretary of State Service officer 1 [not being an officer to whom the first proviso or the second provisos to sub-section (1) applies]who has been paid the rupee equivalent or, as the case may be, the pound sterling equivalent of his pension by calculating such pension with reference to a rate of exchange exceeding the rate of exchange of rupees thirteen and one third to the pound sterling, shall refund to the Central Government or, as the case may be, the State Government, the sum by which the amount paid to him exceeds the amount which would have been payable to him if the calculation had been made at the rate of exchange of rupees thirteen and one-third to the pound sterling and the Central Government or the State Government may set off, in such manner as it may deem fit, the amount required to be so refunded.....

.....8 In the Former Secretary of State Services Officers (Conditions of Service) Act, 1972 (59 of 1972) (hereinafter referred to as the principal Act), in section 8,- (a) in sub-section (1) , after clause (c), the following provisos and Explanations shall be inserted, and shall be deemed always to have been inserted, namely:- 'Provided that in relation to every former Secretary of State Service officer who, having been in service on the 1st day of February, 1921, and domiciled in India on that date, is entitled immediately before the appointed day to claim his pension computed in the rupee equivalent of the amount fixed in sterling at a rate of exchange of rupees fifteen to a pound sterling, clause (c) shall have effect as if for the words "thirteen and one-third", the word "fifteen" were substituted: Provided further that every former Secretary of State Service officer whose pension was expressed in sterling or in respect of whose pension a fixed sterling minimum was applicable, and who, immediately before the appointed day, is a foreigner having taken up permanent residence outside India, shall, so long as he continues to be a foreigner permanently residing outside.....
