Title: General Provisions for Acquition of Operating Rights in the Offshore Areas

.....anything contained in this Act, the Central Government may-- (a) authorise seaward artillery practice under the Seaward Artillery Practice Act, 1949 (8 of 1949); (b) provide for, by notification in the Official Gazette, special measures to ensure public safety and interest, the defence of India and civil defence, conduct of the naval operations and exercises, national security and other strategic considerations and the matters connected therewith during war like conditions or otherwise. (4) No operating right shall be granted or renewed otherwise than in accordance with the provisions of this Act and the rules made thereunder and any reconnaissance permit, exploration licence or production lease granted, renewed or acquired in contravention of the provisions of this Act or any rules made thereunder, shall be void. Section 6 - Grant of operating right The Central Government shall not grant an operating right to any person unless such person-- (a) is an Indian national, or a company as defined in section 3 of the Companies Act, 1956 (1 of 1956); and (b) satisfies such conditions as may be prescribed: Provided that no production lease for atomic.....

THE HARYANA MINERALS (VESTING OF RIGHTS) ACT, 1973 THE HARYANA MINERALS (VESTING OF RIGHTS) ACT, 1973 (Haryana Act No. 48 of 1973) [Received the assent of the President of India on the 16th December, 1973, and first published in Haryana Government Gazette (Extraordinary) of December 20, 1973.] An Act to vest the mineral rights in the State Government and to provide for payment of amount to the owners of minerals and for other matters connected therewith. Be it enacted by the Legislature of the State of Haryana in the Twenty-fourth Year of the Republic of India as follows:- 1. Short title. This Act may be called the Haryana Minerals (Vesting of Rights)Act, 1973. 2. Definitions. In this Act, unless the context otherwise requires," (a) "Collector" means the Deputy Commissioner of a district and includes any officer appointed by the State Government to discharge all or any of the functions of a Collector under this Act; (b) "minerals" mean minerals and minor minerals as defined in clauses (a) and (e) respectively of section 3 of the Mines and Minerals (Regulation and Development) Act, 1957; (c) "land" means land whether assessed to land to land.....

Cess and Other Taxes on Minerals (Validation) Act, 1992 Complete Act

Since refund was likely to have a serious impact on State revenues of the concerned State Governments and having regard to the fact that it is extremely difficult to ensure that the levies collected are refunded to the large number of end users of minerals who have actually borne the burden of such levies, the Cess and Other Taxes on Minerals (Validation) Ordinance, 1992 (Ord. 7 of 1992) was promulgated by the President on the 15th February, 1992, to validate collection of such levies by State Governments up to the 4th day of April. 1991. 2. The Bill seeks to replace the aforesaid Ordinance. SECTION 01: SHORT TITLE, EXTENT AND COMMENCEMENT (1) This Act may be called the Cess and Other Taxes on Minerals (Validation) Act, 1992. (2) It extends to the whole of India. (3) It shall be deemed to have come into force on the 15th day of February, 1992. SECTION 02: VALIDATION OF CERTAIN STATE LAWS AND ACTIONS TAKEN AND THINGS DONE THERE UNDER (1) The laws specified in the Schedule to this Act shall be, and shall be deemed always to have been, as valid as if the provisions contained therein relating to cesses or other taxes on minerals had been enacted by.....

Title: Termination of Operating Right

.....communication, ensuring safety of any offshore structure or conservation of mineral resources, the Central Government may prematurely terminate any operating right in respect of any mineral in any offshore area or part thereof. (2) No order for premature termination of operating right under sub-section (1) shall be made except after giving the holder of operating right a reasonable opportunity of being heard. (3) Where the holder of any operating right fails to commence operation within the period specified in section 14 or discontinues the operation for a period of two years, the operating right shall lapse from the date of execution of the lease or, as the case may be, discontinuance of the operation: Provided that the administering authority, on an application made by the holder of operating right and after being satisfied that such non-commencement of operation or discontinuation thereof, is due to the reasons beyond the control of the holder of operating right, may condone such non-commencement or discontinuation.
