.....the evidence produced by the State servant and after such enquiry as it deems fit, accept the age and date of birth which in its opinion is satisfactorily established; and shall inform the State servant and shall record or cause to be recorded in the service register or book or any other record of service of the State servant the age and date of birth so accepted: Provided that if the age and date of birth of a State servant has been determined by a decree of a civil court obtained by the State servant 1 [after he became such servant] against the State Government and which has become final before the commencement of this Act, the age and date of birth so determined shall be accepted and recorded or caused to be recorded in the service register or book or any other record of service of the State servant concerned. 1 [Provided further that in the case of a State servant who has passed the Secondary School Leaving Certificate Examination or any other examination equivalent thereto, the date of birth and age specified in the certificate evidencing pass in such examination shall be accepted as his date of birth and age:] 2 [Provided further that the powers of the appointing.....

Title: Alteration of Age or Date of Birth of State Servants

.....sub--section (3) shall be deemed to be a civil court and when any offence as is described in section 175, section 178, section 179, section 180 or section 228, of the Indian Penal Code, 1860 (Central Act 45 of 1860) is committed in the view or presence of the said officer, the said officer, may after recording the facts constituting the offence and the statement of the accused as provided for in the Code of the Criminal Procedure, 1973 (Central Act 2 of 1974), forward the case to the Magistrate having jurisdiction to try the same and the Magistrate to whom any such case is forwarded shall proceed to hear the complaint against the accused as if the case had been forwarded to him under section 346 of the Code of Criminal Procedure, 1973. (b) Any proceeding before the said officer shall be deemed to be a judicial proceeding within the meaning of section 193 and 228 of the Indian Penal Code, 1860 (Central Act 45 of 1860). ______________________________________ 1. Notwithstanding anything contained in any law or any judgment, decree or order of any court or other authority, no alteration of the age or date of birth of a State servant as accepted and recorded or deemed to have been accepted and recorded in his service register or book or any other record of service under section 3 shall, in so far as it relates to his conditions of service as such State servant, be made except under section 5.

.....COURT SERVICES (DETERMINATION OF RETIREMENT AGE) ACT, 2008 ACT 34 OF 2008 THE KERALA HIGH COURT SERVICES (DETERMINATION OF RETIREMENT AGE) ACT, 2008 An Act to determine the retirement age of the officers and servants of the High Court of Kerala. Preamble.- WHEREAS, it is considered necessary to determine the retirement age of the officers and servants of the High Court of Kerala on par with the officers and servants of other services of the State; BE it enacted in the Fifty-ninth Year of the Republic of India, as follows:- 1. Short title and commencement.- (1) This Ordinance may be called the Kerala High Court Services (Determination of Retirement Age) Act, 2008. (2) It shall be deemed to have come into force on the 1st day of January, 2007. 2. Determination of Retirement Age in High Court Services.- Notwithstanding anything contained in any other law for the time being in force or in any rule, or in any judgment, decree or order of any court, the compulsory retirement of an officer or servant of the High Court of Kerela shall take effect from the afternoon of the last day of the month in which he attains the age of 55 years. 3. (1) Where it appears to a competent authority that person brought before it under any of the provisions of this Act (otherwise than for the purpose of giving evidence) is a juvenile or the child, the competent authority shall make due inquiry so as to the age of that person and for that purpose shall take such evidence as may be necessary (but not an affidavit) and shall record a finding whether the person is a juvenile or the child or not, stating his age as nearly as may be. (2) No order of a competent authority shall be deemed to have become invalid merely by any subsequent proof that the person in respect of whom the order has been made is not a juvenile or the child, and the age recorded by the competent authority to be the age of person so brought before it, shall for the purpose of this Act, be deemed to be the true age of that person.

(1) When any act or omission would, if a person were under a certain age, be an offence punishable under this Act and such person is, in the opinion of the court, prima facie under such age, the burden shall be on the accused to prove that such person is not under such age. (2) A declaration in writing by a medical officer not below the rank of a Civil Assistant Surgeon relating to an employee that he has personally examined him and believes him to be under the age stated in such declaration, shall, for the purposes of this Act and the rules made thereunder, be admissible as evidence of the age of that employee.
