Government of India Act, 1935 [Repealed] Section 3

Title: The Governor General of India and His Majestys Representative as Regards Relations with Indian States

State: Central

Year: 1935

.....Representative for the exercise of the functions Of the Crown in its relations with Indian States] is appointed by His Majesty in like manner and has such powers and duties in connection with the exercise of those functions (not being powers or duties conferred or imposed by or under this Act on the Governor-General) as His Majesty may be pleased to assign to him. (3) It shall be lawful for His Majesty to appoint one person to fill boththe said offices]. ________________________ 1. The words commencing from 'and' up to the end of the section were omitted by the India (Provisional Constitution) Order,1947. 2. The office was known as "Crown Representative" with effect from 1-4-1937. See notification No. 144--Fed. dated the 4th March 1937, Gazette of India, Pt. I, p. 436.

Government of India Act, 1858 [Repealed] Section 1

Title: Territories Under the Government of the East India Company to Be Vested in Her Majesty and Powers to Be Exercised in Her Name

Year: 1858

The Government of the Territories now in the Possession or under the Government of the East India Company, and all Powers in relation to Government vested in or exercised by the said Company in trust for Her Majesty, shall cease to be vested in or exercised by the said Company, and all Territories in the Possession or under the Government of the said Company, and all Rights vested in or which if this Act had not been passed might have been exercised by the said Company in relation to any Territories, shall become vested in Her Majesty, and be exercised in Her, Name; and for the purposes of this Act India shall mean the Territories vested in Her Majesty as aforesaid, and all Territories which may become vested in Her Majesty by virtue of any such Rights as aforesaid.

Government of India Act, 1858 [Repealed] Section 57

Title: Provisions for Persons Hereafter Entering Her Majestys Indian Forces

State: Central

Year: 1858

Provided, That it shall be lawful fur Her Majesty from Time to Time by Order in Council to alter or regulate the Terms and Conditions of Service under which Persons hereafter entering Her Majesty's Indian Forces shall be commissioned, enlisted, or entered to serve, and the Forms of Attestation and of the Oath or Declaration to be used and taken or made respectively on attesting Persons to serve in Her Majesty's Indian Forces shall be such as Her Majesty with regard to the European Forces, and the Governor General of India in Council with regard to the Native Forces, shall from Time to Time direct: Provided, that every such Order in Council shall be laid before both Houses of Parliament within Fourteen Days after the making thereof, if Parliament be sitting and if Parliament be not sitting, then within Fourteen Days after the next Meeting thereof.

Government of India Act, 1858 [Repealed] Section 2

Title: India to Be Governed by and in the Name of Her Majesty

Year: 1858

India shall be governed by and in the Name of Her Majesty, and all Rights in relation to any Territories which might have been exercised by the said Company if this Act had not been passed shall and may he exercised by any in the name of Her Majesty as Rights incidental to the Government of India; and all the Territorial and other Revenues of or arising in India, and all Tributes and other Payments in respect of any Territories which would have been receivable by or in the Name of the said Company if this Act had not been passed, shall be received for and in the Name of Her Majesty, and shall be applied and disposed of for the purposes of the Government of India alone, subject to the Provisions of this Act.

Government of India Act, 1858 [Repealed] Section 29

Title: Appointment to Be Made by or with the Approbation of Her Majesty

State: Central

Year: 1858

The Appointments of Governor General of India, Fourth Ordinary Member of the Council of the Governor General of India, and Governors of Presidencies in India, now made by the Court of Directors with the Approbation of Her Majesty, and the Appointments of Advocate-General for the several Presidencies now made with the Approbation of the Commissioners for the Affairs of India, shall be made by Her Majesty by Warrant under Her Royal Sign Manual; the Appointments of the Ordinary Members of the Council of the Governor- General of India, except the Fourth Ordinary Member and the Appointments of the Members of the Council of the several Presidencies, shall be made by the Secretary of State in Council; the Appointments of the Lieutenant Governors of Provinces or Territories shall be made by the Governor General of India subject to the Approbation of Her Majesty; and all such Appointments shall be subject to the Qualifications now by Law affecting such Office respectively.

COLONIAL COURTS OF ADMIRALTY ACT, 1890 Section 4

Title: Reservation of Colonial law for Her Majesty's assent

Every Colonial law which is made in pursuance of this Act, or affects the jurisdiction of or practice or procedure in any Court of such possession in respect of the jurisdiction conferred by this Act, or alters any such Colonial law as above in this section mentioned, which has been previously passed, shall unless previously approved by Her Majesty through a Secretary of State, either be reserved for the signification of Her Majesty's pleasure thereon, or contain a suspending clause providing that such law shall not come into operation until Her Majesty's pleasure thereon has been publicly signified in the British possession in which it has been passed. 1[This section shall not apply to Indian laws2[* *].] ________________________ 1. Government of India Act, 1935 [Repealed] Section 229

Title: Power of His Majesty to Constitute or Reconstitute High Court by Letters Patent

Year: 1935

(1) His Majesty, if the Chamber or Chambers of the Legislature of any Province present an address in that behalf to the Governor of the Province for submission to His Majesty, may by letters patent constitute a High Court for that Province or any part thereof or reconstitute in like manner any existing High Court for that Province or for any part thereof, or, where there are two High Courts in that Province amalgamate those courts. (2) Where any Court is reconstituted, or two Courts are amalgamated, as aforesaid, the letters patent shall provide for the continuance in their respective offices of the existing judges, officers and servants of the Court or Courts, and for the carrying on before the reconstituted Court or the new Court of all pending matters, and may contain such other provisions as may appear to His Majesty to be necessary by reason of the reconstitution or amalgamation.

Title: Control of His Majesty as to Defence Appointments

1[233. Control of his Majesty as to Defence appointments (1) His Majesty in Council may require that appointments to such offices connected with in such manner as he may direct.1 (2) Nothing in this section derogates from any power vested in His Majesty by virtue of any Act or by virtue of his Royal Prerogative. ________________________ 1. Title: Use of His Majestys Forces in Connection with Discharge of the Functions of the Crown in Its Relations with Indian States

1[286. Use of His Majesty's forces in connection with discharge of the functions of the Crown in its relations with Indian States (1) If His Majesty's Representative for the exercise of the functions of the Crown in its relations with Indian States requests the assistance of armed forces for the clue discharge of those functions, it shall be the duty of the Governor-General in the exercise of the executive authority of the Federation to cause the necessary forces to be employed accordingly, but the net additional expense, if any, incurred in connection with those forces by reason of that employment shall be deemed to be expenses of His Majesty incurred in discharging the said functions of the Crown. Government of India Act, 1858 [Repealed] Section 33

Title: Other Appointments and Admissions to Service Vested in Her Majesty

State: Central

Year: 1858

All Appointments to Cadetships, Naval and Military, and all Admissions to Service not herein otherwise expressly provided for, shall be vested in Her Majesty; and the Names of Persons to be from Time to Time recommended for such Cadetships and Service shall be submitted to Her Majesty by the Secretary of State.
