THE SIKKIM PRISONS ACT, 2007 THE SIKKIM PRISONS ACT, 2007 (Act No. 16 of 2007) AN ACT To provide for a law regulating the prisons in Sikkim. Be it enacted by the Legislature of Sikkim in the Fifty-eighth Year of the Republic of India as follows: - CHAPTER I Short title, extent and commencement. 1. (1) This Act may be called the Sikkim Prisons Act, 2007 (2) It extends to the whole of Sikkim; (3) It shall come into force on such date as the State Government may, by notification, in the official gazette appoint. Definitions. In this Act, unless the context otherwise requires: - (a) "civil prisoner" means any prisoner who is not a criminal prisoner; 2 . (b) "Competent authority" means any officer having jurisdiction and legal authority to deal with a particular matter in question; (c) "convicted criminal prisoner" means any criminal prisoner under sentence of court or court-martial, and includes a person detained in prison under the provision of Code of Criminal Procedure, 1973; (d) "Court" includes any officer lawfully exercising civil, criminal or revenue jurisdiction; (e) "criminal prisoner" means any prisoner duly committed to custody.....

Title: Jurisdiction, Powers and Authority of the Tribunal

(1) Any person who is guilty of contempt of the Tribunal by using any insulting or threatening language, or by causing any interruption or disturbance in the proceedings of such Tribunal shall, on conviction, be liable to suffer imprisonment for a term which may extend to three years. (2) For the purposes of trying an offence under this section, the provisions of sections 14, 15, 17, 18 and 20 of the Contempt of Courts Act, 1971 shall mutatis mutandis apply, as if a reference therein to-- (a) Supreme Court or High Court were a reference to the Tribunal; (b) Chief Justice were a reference to the Chairperson; (c) Judge were a reference to the Judicial or Administrative Member of the Tribunal; (d) Advocate-General were a reference to the prosecutor; and (e) Court were a reference to the Tribunal. Section 20 - Distribution of business among the Benches The Chairperson may make provisions as to the distribution of the business of the Tribunal among its Benches.

Title: Examination of a Witness on Commission

.....by counsel, or, except in the case of an accused person in custody, in person, and may examine, cross-examine and re-examine, as the case may be, the said witness. (3) After a commission issued under section 103 has been duly executed, it shall be returned, together with the deposition of the witness examined thereunder to the Judge Attorney-General. (4) On receipt of a commission, and deposition returned under sub-section (3), the Judge Attorney-General shall forward the same to the Court at whose instance the commission was issued or, if such Court has been dissolved, to any other Court convened for the trial of the accused person; and the commission, the return thereto and the deposition shall be open to inspection by the prosecutor and the accused person, and may, subject to all just exceptions, be read in evidence in the case by either the prosecutor or the accused, and shall form part of the proceedings of the Court. (5) In every case in which a commission is issued under section 103, the trial may be adjourned for specified time reasonably sufficient for the execution and return of the commission.
