Title: Decision of the Civil Judge Junior Division

.....or any of the returned candidates to be void and the petitioner or any other candidates to have been duly elected. (2) At the time of making an order under sub-section (1) the1[Civil Judge (Junior Division)] shall also make an order,- (a) where any charge is made in the petition of the corrupt practice having been committed at the election, recording,- (i) a finding whether any corrupt practice has or has not been proved to have been committed at the election and the nature of that corrupt practice; and (ii) the names of all persons, if any, who have been proved at the trail to have been guilty of any corrupt practice and the nature of that practice; and (b) fixing the total amount of the costs payable and specifying the person by and to whom costs shall be paid: Provided that a person who is not a party to the petition shall not be named in the order under sub-clause (ii) of the clause (a) unless,- (i) he has been given notice to appear before the1[Civil Judge (Junior Division)] and to show-cause why he should not be so named; and (ii) if he appears in pursuance of the notice, he has been given an opportunity of cross examining any witness who has already been.....

Civil Courts Act, 1964 Section 20

Title: Appeals from Civil Judge (Junior Division)

.....of a civil nature, shall, when such appeals are allowed by law, lie to the2[Court of the Civil Judge (Senior Division)]. ______________________ 1. This section is substituted by Act 81 of 1976 as follows but not yet brought into force. 20. Appeals from Civil Judge (Junior Division).- (1) Appeals from the decrees and orders passed by a Civil Judge (Junior Division) in original suits and proceedings of a civil nature, shall, when such appeals are allowed by law, lie,- (i) to the Court of the Civil Judge (Senior Division) , when the amount or value of the subject matter of the original suit or proceedings is not more than five thousand rupees; (ii) to the District Court, in other cases. (2) Not withstanding anything contained in sub-section (1), but subject to the general or special orders of the High Court, the District Court may, at any stage, withdraw any appeal pending before a Court of the Civil Judge (Senior Division) subordinate to it and dispose of the same, and in respect of such appeal, the District Court shall, for the purpose of this Act, be deemed to be the competent appellate Court. 2. Power to invest the Court of the 1 [Civil Judge (Senior Division)] and the 1 [Court of a Civil Judge (Junior Division)] with Small Cause powers (1) The High Court, may, by notification, invest within such limits, as it shall, from time to time, determine, any 1 [Court of a Civil Judge (Senior Division)] or a 1 [Court of a Civil Judge (Junior Division)] with jurisdiction for the trial of suits cognizable by a Court of Small Causes up to such amount as it may deem proper not exceeding in the case of a 1 [Court of a Civil Judge (Senior Division)] 2 [3 [twenty-five thousand] rupees], and in the case of 1 [Court of a Civil Judge (Junior Division)], 3 [three thousand] rupees. (2) The High Court, may, by notification, withdraw or alter, whenever it thinks fit, such jurisdiction of any Court of the 1 [Civil Judge (Senior Division)] or 1 [Court of a Civil Judge (Junior Division)] so invested. ______________________ 1. In the State Bank of Kurundwad (Junior) Act, 1933 (a) in section 22, for the words "The Indian Companies Act as applied to the State the words and figures "The Companies Act, 1956" shall be substituted and (b) after section 22, the following section shall be inserted namely "22A.Special provision for winding up of the bank.- No provision of law relating to the winding up of companies or corporations shall apply to the bank and- (i) the provisions of section 5 of the State Associated Banks (Miscellaneous Provisions) Act, 1962 ( 56 of 1962), except the provisions of clauses (d) and (e) of subsection (I) thereof, and (ii) the provisions of section 45-O of the Banking Companies Act, 1949(10 of 1949), shall apply to or in relation to the bank as if reference to the court were references to the principal civil court of original jurisdiction in the district in which the banks head office is situated and references to the Dholpur bank were reference to the State Bank of Kurundwad (Junior) Ltd"
