JUDICIAL OFFICERS' PROTECTION ACT, 1850 Section 1

Title: Non-liability to suit of officers acting judicially, for official acts done in good faith, and of officers executing warrants and orders

Year: 1850

No Judge, Magistrate, Justice of the Peace, Collector or other person acting judicially shall be liable to be sued in any Civil Court for any act done or ordered to be done by him in the discharge of his judicial duty, whether or not within the limits of his jurisdiction: PROVIDED that he at the time in good faith, believed himself to have jurisdiction to do or order the act complained of; and no officer of any Court or other person, bound to execute the lawful warrants or orders of any such Judge, Magistrate, Justice of the Peace, Collector or other person acting judicially shall be liable to be sued in any Civil Court, for the execution of any warrant or order, which he would be bound to execute, if within the jurisdiction of the person issuing the same.

Abolition of Privy Council Jurisdiction Act, 1949 [Repealed] Section 4

Title: Continuance of Privy Council Jurisdiction in Certain Pending Cases

Nothing contained in shall affect the jurisdiction of His Majesty in Council to dispose of- (a) any Indian appeal or petition on which the Judicial Committee of the Privy Council has before the appointed day delivered judgment or, as the case may be, reported to His Majesty, but which has not been determined by an Order in Council of His Majesty; or (b) any Indian appeal or petition on which the Judicial Committee has after hearing the parties, reserved judgment or order; or (c) any Indian appeal which has been entered before the appointed day in the list of business of the Judicial Committee for the Michaelmas sittings of the year 1949 and which after that day is not directed to be removed there from, by or under the authority of the Judicial Committee; or (d) any Indian petition which has been lodged before the appointed day in the Registry of the Privy Council.

Title: Exception and modification subject to which the provisions of Chapter V of Part VI of the Constitution apply to the Judicial Commissioner's Courts

The provisions of Chapter V of Part VI of the Constitution shall, in their application to a Judicial Commissioners Court, have effect subject to the following exceptions and modifications, namely: - (a) the provisions of Articles 216, 217, 218, 220, 221, 222, 223, 224, 230 and 231 shall not apply; (b) references in Article 219, in the proviso to clause (3) of Article 227 and in Article 229 to the Governor shall be construed as references to the administrator of the Union territory in relation to which that Court exercises jurisdiction.

Title: Transfer of Pending Proceedings from the Court of the Judicial Commissioner to the Bombay High Court

Year: 1981

(1) All proceedings pending in the Court of the Judicial Commissioner immediately before the appointed day shall stand transferred to the High Court at Bombay. (2) Every proceeding transferred under sub-section (1) shall be disposed of by the High Court at Bombay as if such proceeding were entertained by that High Court. (3) Any order made before the appointed day by the Court of the Judicial Commissioner shall, for all purposes, have effect not only as an order of that Court but also as an order of the High Court at Bombay.
