Title: Investigation into Misbehaviour or Incapacity of Judge by Committee

(7) If the Judge refuses to undergo medical examination considered necessary by the Medical Board, the Board shall submit a report to the Committee stating therein the examination which the Judge has refused to undergo, and the Committee may, on receipt of such report, presume that the Judge suffers from such physical or mental incapacity as is alleged in the motion referred to in sub-section (1). (8) The Committee may, after considering the written Statement of the Judge and the medical report, if any, amend the charges framed under sub-section (3) and in such a case, the Judge shall be given a reasonable opportunity of presenting a fresh written Statement of defence. (9) The Central Government may, if required by the Speaker or the Chairman, or both, as the case may be, appoint an advocate to conduct the case against the Judge.

Title: Special Provisions in Respect of Continuing Judges

.....Act, his previous service for pension as a Chief Justice or as a Judge of a former High Court in a Part B State, under the provisions of the High Court Judges (Part B States) Order, 1953, or any other order or rule then applicable to him, shall be reckoned as service for pension as a Chief Justice or, as the case may be, as a Judge under this Act. (2) In the calculation of the amount of leave at the credit of a continuing Judge for the purposes of this Act, the amount of leave due to him immediately before the 1st day of November, 1956, under the provisions of the High Court Judges (Part B States) Order, 1953, or any other order or rule then applicable to him, shall be added to the amount of leave at his credit under this Act. (3) In this section, "continuing Judge" means a Judge of a former High Court in a Part B State who on the 1st day of November, 1956, or on any date subsequent thereto has become or been appointed as a Judge of a High Court for a State.] ________________________ 1. In the Supreme Court Judges (Salaries and Conditions of Service) Act, 1958(41 of 1958) (hereinafter referred to as the Supreme Court Judges Act), in section 12 A,-- (a) in sub-section (1), for the words "thirty-three thousand rupees per mensem", the words "one lakh rupees per mensem" shall be substituted; (b) in sub-section (2), for the words "thirty thousand rupees per mensem", the words "ninety thousand rupees per mensem" shall be substituted. Section 9 - Amendment of section 16A In section 16A of the Supreme Court Judges Act, in sub-section (1),-- (i) in clause (a), the words "plus fifty per cent, of his dearness pay" and "plus thirty per cent, of his dearness pay" shall be omitted; (ii) in clause (b), the words "plus thirty per cent, of his dearness pay" shall be omitted. Section 10 - Insertion of new section 16B After section 16 A of the Supreme Court Judges Act, the following section shall be inserted, namely:-- " 16B. Title: Pension Payable to Judges

Subject to the provisions of this Act, apension shall be payable in accordance with the provisions of Part I of theSchedule to a Judge of the Supreme Court on his retirement, if, but only if,-- (a) 1 [Omitted] (b) he has attained the age of sixty-fiveyears; or (c) his retirement is medically certifiedto be necessitated by ill-health.
