Bureau of Indian Standards Act, 1986 Section 25

Title: Inspecting Officer

(1)The Bureau may appoint as many inspecting officers as may be necessary for the purpose of inspecting whether any article or process in relation to which the Standard Mark has been used conforms to the Indian Standard or whether the Standard Mark has been properly used in relation to any article or process with or without licence, and for the purpose of performing such other functions as may be assigned to them. (2) Subject to any rules made under this Act, an inspecting officer shall have power to-- (a) inspect any operation carried on in connection with any article or process in relation to which the Standard Mark has been used; and (b) take samples of any article or of any material or substances used in any article or process, in relation to which the Standard Mark has been used. (3) Every inspecting officer shall be furnished by the Bureau with a certificate of appointment's an inspecting officer and the certificate shall, on demand, be produced by the inspecting officer.

(1) The State Government may, by notification, appoint Inspecting Officers to inspect the prescribed books of account kept under section 5. (2) The Inspecting Officers shall perform such duties and exercise such powers as may be prescribed for the purpose of carrying into effect the provisions of this Act and the rules made thereunder. (3) Every Inspecting Officer appointed under this section shall be deemed to be a public servant within the meaning of section 21 of the Indian Penal Code (Central Act XLV of 1860), and the Prevention of Corruption Act, 1947 (Central Act II of 1947).

Title: Appointment of Inspecting Officers and Recovery in Cases Reported by Them

.....under this Act on any document filed, exhibited or recorded in such case has not been paid or has been insufficiently paid, he shall report the fact to the Presiding Officer of the Court. (4) Such Presiding Officer, after satisfying himself of the correctness of such report, shall record a provisional finding that the proper fee has not been paid and determine the amount of the fee payable and such further sum as he thinks reasonable as the costs of the inquiry and the person from whom the fee or the difference thereof, if any, and the costs shall be, recoverable. (5) After recording a finding under sub-section (4), the Presiding Officer shall issue a notice to the person referred to in that sub-section to show cause why he should not be ordered to pay the fee and costs determined hereunder, and, if sufficient cause is not shown, the Presiding Officer shall conform the finding and make an order requiring such person to pay the proper fee and the costs before a specified date. (6) If such person fails to pay the fee and the costs in accordance with the provisions of sub-section (5), they shall, on the certificate of such Presiding Officer, be recoverable as an arrear of.....

Title: Inspection of Psychiatric Hospitals and Psychiatric Nursing Homes and Visiting of Patients

.....any psychiatric hospital or psychialric nursing home and require the production of any records, which are required to be kept in accordance with the rules made in this behalf, for inspection: Provided that any personal records of a patient so inspected shall be kept confidential except for the purposes of sub-section (3). (2) The Inspecting Officer may interview in private any patient receiving treatment and care therein-- (a) for the purpose of inquiring into any complaint made by or on behalf of such patient as to the treatment and care, or (b) in any case, where the Inspecting Officer has reason to believe that any inpatient is not receiving proper treatment and care. (3) Where the Inspecting Officer is satisfied that any inpatient in a psychiatric hospital or psychiatric nursing home is not receiving proper treatment and care, he may report the matter to the licensing authority and thereupon the licensing authority may issue such direction as it may deem fit to the medical officer in charge or the licensee of the psychiatric hospital, or, as the case may be, the psychiatric nursing home and every such medical officer in charge or licensee shall be bound to comply.....

.....of any equipment or appliance checked or verified by him; (iii) To record the statement of any person which may be useful for, or relevant to, for efficient use of energy and its conservation under this Act. (3) An inspecting officer may enter any place of designated consumer-- (a) Where any activity with the help of energy is carried on; and (b) Where any equipment or appliance notified under clause (b) of section 14 has been kept,during the hours at which such place is open for production or conduct of business connected therewith.
